Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Military Housing 4 Transparency and Accountability Act’’. 5 SEC. 2. ESTABLISHING ADDITIONAL REQUIREMENTS FOR A 6 MILITARY HOUSING COMPLAINT DATABASE. 7 Section 2894a of title 10, United States Code, is 8 amended— 9 VerDate Sep 11 2014 02:17 May 20, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3165.IH H3165 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 3165 IH (1) in subsection (a) by striking ‘‘regarding 1 housing units’’ and inserting ‘‘by a tenant regarding 2 covered dwelling units’’; 3 (2) in subsections (c) and (d) by striking ‘‘hous- 4 ing unit’’ each place it appears and inserting ‘‘cov- 5 ered dwelling unit’’; and 6 (3) by inserting after subsection (e) the fol- 7 lowing new subsections: 8 ‘‘(f) ANNUAL REPORT.— 9 ‘‘(1) IN GENERAL.—The Deputy Assistant Sec- 10 retary of Defense for Housing shall submit to the 11 Committees on Armed Services of the House of Rep- 12 resentatives and the Senate, and make available to 13 each Secretary of a military department, an annual 14 report that includes, during the year covered by such 15 report— 16 ‘‘(A) a summary of the data collected 17 using the database established under subsection 18 (a); 19 ‘‘(B) an aggregation of the complaints cat- 20 egorized by type, in accordance with paragraph 21 (2), and military installation, if applicable; and 22 ‘‘(C) the actions taken to remedy com- 23 plaints received during the period covered by 24 such report. 25 VerDate Sep 11 2014 02:17 May 20, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3165.IH H3165 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3165 IH ‘‘(2) TYPE OF COMPLAINTS.—In categorizing 1 complaints by type pursuant to paragraph (1)(B), 2 the Secretary shall aggregate complaints based on 3 the following categories: 4 ‘‘(A) Physiological hazards, including 5 dampness and mold growth, lead-based paint, 6 asbestos and manmade fibers, radiation, 7 biocides, carbon monoxide, and volatile organic 8 compounds. 9 ‘‘(B) Psychological hazards, including ease 10 of access by unlawful intruders, faulty locks or 11 alarms, and lighting issues. 12 ‘‘(C) Safety hazards. 13 ‘‘(D) Maintenance timeliness. 14 ‘‘(E) Maintenance quality. 15 ‘‘(g) DEFINITIONS.—In this section: 16 ‘‘(1) The term ‘covered dwelling unit’ means a 17 unit of accompanied family housing, unaccompanied 18 housing, or barracks— 19 ‘‘(A) in which a member of the armed 20 forces resides; and 21 ‘‘(B) that the member does not own. 22 ‘‘(2) The term ‘tenant’ means any of the fol- 23 lowing: 24 VerDate Sep 11 2014 02:17 May 20, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3165.IH H3165 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 3165 IH ‘‘(A) A member of the armed forces who 1 resides in a covered dwelling unit. 2 ‘‘(B) A dependent of a member described 3 in subparagraph (A) who resides in a covered 4 dwelling unit.’’. 5 Æ VerDate Sep 11 2014 02:17 May 20, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H3165.IH H3165 kjohnson on DSK79L0C42PROD with BILLS
