SHORT TITLE. 1 This Act may be cited as the ‘‘Hong Kong Business 2 Integrity and Transparency Act’’. 3 SEC. 2. REPORT ON REQUESTS FROM GOVERNMENT OF 4 HONG KONG TO UNITED STATES COMPANIES 5 FOR CONSUMER INFORMATION, CONTENT 6 TAKEDOWNS, OR LAW ENFORCEMENT ASSIST- 7 ANCE. 8 (a) IN GENERAL.—Not later than 180 days after the 9 date of the enactment of this Act, and every 180 days 10 thereafter, the Secretary of Commerce, in consultation 11 with the heads of other appropriate Federal departments 12 and agencies, shall submit to the appropriate congres- 13 sional committees and make available to the public a re- 14 port on— 15 (1) the protection of consumer information in 16 the possession of United States companies operating 17 in Hong Kong; and 18 (2) requests issued by the Government of Hong 19 Kong to United States companies operating in Hong 20 Kong for content takedowns or law enforcement as- 21 sistance. 22 (b) MATTERS TO BE INCLUDED.—The report re- 23 quired by subsection (a) shall, with respect to the 180- 24 day period preceding the date of submission of the report, 25 include the following: 26 VerDate Sep 11 2014 22:50 May 01, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2815.IH H2815 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 2815 IH (1) The number of requests, issued by the Gov- 1 ernment of Hong Kong to United States companies 2 operating in Hong Kong for consumer information 3 in the possession of such companies, content take- 4 downs, or law enforcement assistance, that were ful- 5 filled and by which companies. 6 (2) An identification of the Hong Kong laws 7 under which such requests were issued. 8 (3) An identification of any United States con- 9 sumer protection laws that may have been violated 10 in the case of the fulfillment of such requests by 11 such companies. 12 (c) FORM OF REPORT.—The report required by sub- 13 section (a) shall be submitted in unclassified form, but 14 may include a classified index. 15 (d) DEFINITIONS.—In this section: 16 (1) APPROPRIATE CONGRESSIONAL COMMIT- 17 TEES.—The term ‘‘appropriate congressional com- 18 mittees’’ means— 19 (A) the Committee on Commerce, Science, 20 and Transportation, the Committee on Foreign 21 Relations, the Committee on Banking, Housing, 22 and Urban Affairs, the Committee on Finance, 23 and the Select Committee on Intelligence of the 24 Senate; and 25 VerDate Sep 11 2014 22:50 May 01, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2815.IH H2815 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 2815 IH (B) the Committee on Energy and Com- 1 merce, the Committee on Foreign Affairs, the 2 Committee on Financial Services, the Perma- 3 nent Select Committee on Intelligence, and the 4 Committee on Ways and Means of the House of 5 Representatives. 6 (2) CONTENT TAKEDOWN.—The term ‘‘content 7 takedown’’ means the removal of, disabling of access 8 to, or restriction of access to any material, includ- 9 ing— 10 (A) material on a website or online service; 11 (B) a software application; and 12 (C) any feature of a software application. 13 Æ VerDate Sep 11 2014 22:50 May 01, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H2815.IH H2815 kjohnson on DSK79L0C42PROD with BILLS
