R. 2838 To require the Secretary of the Treasury to mint coins in commemoration of the 75th anniversary of what is recognized as the first sanctioning body created to promote a unified series of competitions, with an orga- nized group of race car drivers. The first such recognized race was held at Daytona Beach on February 15, 1948, under the sanctioning of the ‘‘National Association for Stock Car Auto Racing’’ (NASCAR). SHORT TITLE. 1 This Act may be cited as the ‘‘National Association 2 for Stock Car Auto Racing (NASCAR) 75th Anniversary 3 Commemorative Coin Act’’. 4 SEC. 2. FINDINGS. 5 This Congress finds the following: 6 (1) On February 15, 2023, the National Asso- 7 ciation for Stock Car Auto Racing (NASCAR) ob- 8 served the 75th anniversary of the first race hosted 9 by a sanctioning body, held at Daytona Beach, Flor- 10 ida. 11 (2) In December 1947, Bill France, Sr., orga- 12 nized several meetings at the Streamline Hotel in 13 Daytona Beach, Florida, at which time his vision of 14 an organized group of race car drivers was con- 15 ceived. 16 (3) On February 15, 1948, Red Bryon won the 17 first sanctioned body event, defeating Marshall 18 Teague on the Daytona Beach road course. 19 (4) More than 41,000 fans attended the Inau- 20 gural Daytona 500 on February 22, 1959, won by 21 Lee Petty. 22 (5) At the Jacksonville, Florida, Speedway on 23 December 1, 1963, Wendell Scott became the first 24 Black driver to win a NASCAR sanctioned race. 25 VerDate Sep 11 2014 22:57 May 01, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2838.IH H2838 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 2838 IH (6) In 1977, Janet Guthrie became the first 1 woman to compete in the Daytona 500. 2 (7) On February 18, 1979, CBS televised the 3 first live coverage of the Daytona 500. 4 (8) In August 1994, the Indianapolis Motor 5 Speedway was added to the race schedule. 6 (9) Betty Jane France founded The NASCAR 7 Foundation in 2006, supporting causes that work to 8 improve the lives of children in need. 9 (10) On May 23, 2020, the inaugural NASCAR 10 Hall of Fame class (Bill France, Sr., Bill France, 11 Jr., Richard Petty, Dale Earnhardt, and Junior 12 Johnson) is inducted in Charlotte, North Carolina. 13 (11) Danica Patrick becomes the first female to 14 win a pole in the Daytona 500 in 2013. 15 (12) Jimmie Johnson makes history with his 16 record-tying seventh race championship on Novem- 17 ber 20, 2016. 18 (13) Before a sold-out crowd of 101,500 fans at 19 the Daytona International Speedway on February 20 20, 2022, the Next-Gen car debuted in the 64th an- 21 nual Daytona 500. 22 (14) NASCAR has grown from the small orga- 23 nization formed on the sands of Daytona Beach to 24 one of the most popular sports in the world. 25 VerDate Sep 11 2014 22:57 May 01, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2838.IH H2838 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 2838 IH SEC. 3. COIN SPECIFICATIONS. 1 (a) $1 SILVER COINS.—The Secretary of the Treas- 2 ury (hereafter in this Act referred to as the ‘‘Secretary’’) 3 shall mint and issue $1 coins in recognition of the 4 NASCAR 75th anniversary, which shall— 5 (1) weigh 26.73 grams; 6 (2) have a diameter of 1.500 inches; and 7 (3) contain not less than 90 percent silver. 8 (b) LEGAL TENDER.—The coins minted under this 9 Act shall be legal tender, as provided in section 5103 of 10 title 31, United States Code. 11 (c) NUMISMATIC ITEMS.—For purposes of sections 12 5134 and 5136 of title 31, United States Code, all coins 13 minted under this Act shall be considered to be numis- 14 matic items. 15 SEC. 4. DESIGNS OF COINS. 16 (a) DESIGN REQUIREMENTS.— 17 (1) IN GENERAL.—The design of coins minted 18 under this Act shall be emblematic of the National 19 Association for Stock Car Auto Racing and the com- 20 petitive spirit of American auto racing enthusiasts. 21 (2) DESIGNS AND INSCRIPTIONS.—On the coin 22 minted under this Act, there shall be— 23 (A) a designation of the value of the coin; 24 (B) an inscription of the year ‘‘2023’’; and 25 VerDate Sep 11 2014 00:34 May 02, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2838.IH H2838 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 2838 IH (C) inscriptions of the words ‘‘Liberty’’, 1 ‘‘In God We Trust’’, ‘‘United States of Amer- 2 ica’’, and ‘‘E Pluribus Unum’’. 3 (b) SELECTION.—The designs for the coins minted 4 under this Act shall be— 5 (1) selected by the Secretary, after consultation 6 with the NASCAR Foundation and the Commission 7 of Fine Arts; and 8 (2) reviewed by the Citizens Coinage Advisory 9 Committee. 10 SEC. 5. ISSUANCE OF COINS. 11 (a) QUALITY OF COINS.—Coins minted under this 12 Act shall be issued in uncirculated and proof qualities. 13 (b) MINT FACILITY.—Only 1 facility in the United 14 States Mint may be used to strike any particular quality 15 of the coins minted under this Act. 16 (c) PERIOD FOR ISSUANCE.—The Secretary may 17 issue coins minted under this Act only during the 1-year 18 period beginning on January 1, 2023. 19 SEC. 6. SALE OF COINS. 20 (a) SALE PRICE.—The coins issued under this Act 21 shall be sold by the Secretary at a price equal to the sum 22 of— 23 (1) the face value of the coins; 24 VerDate Sep 11 2014 00:34 May 02, 2023 Jkt 039200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H2838.IH H2838 kjohnson on DSK79L0C42PROD with BILLS 6 •HR 2838 IH (2) the surcharge provided in section 7(a) with 1 respect to such coins; and 2 (3) the cost of designing and issuing the coins 3 (including labor, materials, dies, use of machinery, 4 overhead expenses, marketing, and shipping). 5 (b) BULK SALES.—The Secretary shall make bulk 6 sales of the coins issued under this Act at a reasonable 7 discount. 8 (c) PREPAID ORDERS.— 9 (1) IN GENERAL.—The Secretary shall accept 10 prepaid orders for the coins minted under this Act 11 before the issuance of such coins. 12 (2) DISCOUNT.—Sale prices with respect to pre- 13 paid orders under paragraph (1) shall be at a rea- 14 sonable discount. 15 SEC. 7. SURCHARGES. 16 (a) IN GENERAL.—All sales of coins issued under this 17 Act shall include a surcharge of $20 per coin for the $1 18 coin. 19 (b) DISTRIBUTION.—Subject to section 5134(f)(1) of 20 title 31, United States Code, all surcharges received by 21 the Secretary from the sale of coins issued under this Act 22 shall be promptly paid by the Secretary to The NASCAR 23 Foundation for application to general expenses associated 24 VerDate Sep 11 2014 22:57 May 01, 2023 Jkt 039200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H2838.IH H2838 kjohnson on DSK79L0C42PROD with BILLS 7 •HR 2838 IH with the fulfillment of the mission of The NASCAR Foun- 1 dation. 2 (c) AUDITS.—The Comptroller General of the United 3 States shall have the right to examine such books, records, 4 documents, and other data of each of the organizations 5 referred to in subsection (b) as may be related to the ex- 6 penditures of amounts paid under that subsection. 7 (d) LIMITATION.—Notwithstanding subsection (a), 8 no surcharge may be included with respect to the issuance 9 under this Act of any coin during a calendar year if, as 10 a result of the time of such issuance, the issuance of such 11 coin would result in the number of commemorative coin 12 programs issued during such year to exceed the annual 13 2 commemorative coin program issuance limitation under 14 section 5112 (m)(1) of title 31, United States Code (as 15 in effect on the date of the enactment of this Act). The 16 Secretary of the Treasury may issue guidance to carry out 17 this subsection. 18 SEC. 8. FINANCIAL ASSURANCES. 19 The Secretary shall take such actions as may be nec- 20 essary to ensure that— 21 (1) minting and issuing coins under this Act 22 will not result in any net cost to the United States 23 Government; and 24 VerDate Sep 11 2014 22:57 May 01, 2023 Jkt 039200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H2838.IH H2838 kjohnson on DSK79L0C42PROD with BILLS 8 •HR 2838 IH (2) no funds, including applicable surcharges, 1 are disbursed to any recipient designated in section 2 7 until the total cost of designing and issuing all of 3 the coins authorized by this Act (including labor, 4 materials, dies, use of machinery, overhead expenses, 5 marketing, and shipping) is recovered by the United 6 States Treasury, consistent with sections 5112(m) 7 and 5134(f) of title 31, United States Code. 8 SEC. 9. BUDGETARY EFFECTS. 9 (a) STATUTORY PAYGO SCORECARDS.—The budg- 10 etary effects of this section shall not be entered on either 11 PAYGO Scorecard maintained pursuant to section 4(d) of 12 the Statutory Pay-As-You-Go Act of 2010 (U.S.C. 13 933(d)). 14 (b) SENATE PAYGO SCORECARDS.—The budgetary 15 effects of this section shall not be entered on any PAYGO 16 scorecard maintained for purposes of section 4105 of H. 17 Con.
