Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. ALLOCATION OF COSTS OF CERTAIN TRANSMISSION 1 FACILITIES. 2 Part II of the Federal Power Act (16 U.S.C. 824 et 3 seq.) is amended by adding at the end the following: 4 ‘‘SEC. 224. ALLOCATION OF COSTS OF CERTAIN TRANS- 5 MISSION FACILITIES. 6 ‘‘(a) ALLOCATION OF COSTS.— 7 ‘‘(1) IN GENERAL.—Any entity that proposes to 8 own, control, or operate a transmission facility of 9 national significance may file a tariff with the Com- 10 mission in accordance with section 205 and the reg- 11 ulations of the Commission allocating the costs of 12 such transmission facility of national significance. 13 ‘‘(2) COST CAUSATION PRINCIPLE.—The Com- 14 mission shall require that any tariff filed under 15 paragraph (1) allocate the costs of a transmission 16 facility of national significance to customers within 17 the applicable transmission planning region or re- 18 gions in a manner that is at least roughly commen- 19 surate with the estimated anticipated benefits de- 20 scribed in paragraph (3). 21 ‘‘(3) COST ALLOCATION PRINCIPLE.—The Com- 22 mission shall require that any tariff filed under 23 paragraph (1) allocate costs based on the broad 24 range of reliability, economic, public policy, resil- 25 ience, and other reasonably anticipated benefits of 26 VerDate Sep 11 2014 22:14 Apr 26, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2750.IH H2750 pbinns on DSKJLVW7X2PROD with $$_JOB 3 •HR 2750 IH the applicable transmission facility of national sig- 1 nificance. 2 ‘‘(b) TRANSMISSION FACILITY OF NATIONAL SIG- 3 NIFICANCE.—In this section, the term ‘transmission facil- 4 ity of national significance’ means— 5 ‘‘(1) an interstate electric power transmission 6 line (and any facilities necessary for the operation of 7 such electric power transmission line) or an electric 8 power transmission line that is located offshore (and 9 any facilities necessary for the operation of such 10 electric power transmission line)— 11 ‘‘(A) that has a transmission capacity of 12 not less than 1,000 megawatts; and 13 ‘‘(B) the construction of which is com- 14 pleted on or after the date of enactment of this 15 section; or 16 ‘‘(2) an expansion of, or upgrade to, an inter- 17 state electric power transmission line (and any facili- 18 ties necessary for the operation of such electric 19 power transmission line) or an electric power trans- 20 mission line that is located offshore (and any facili- 21 ties necessary for the operation of such electric 22 power transmission line) that— 23 VerDate Sep 11 2014 22:14 Apr 26, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2750.IH H2750 pbinns on DSKJLVW7X2PROD with $$_JOB 4 •HR 2750 IH ‘‘(A) increases the transmission capacity of 1 such electric power transmission line by at least 2 500 megawatts; and 3 ‘‘(B) is completed on or after the date of 4 enactment of this section. 5 ‘‘(c) SAVINGS PROVISION.—This section does not af- 6 fect the authority of the Commission to approve the alloca- 7 tion of costs of transmission facilities other than trans- 8 mission facilities of national significance.’’. 9 Æ VerDate Sep 11 2014 22:14 Apr 26, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H2750.IH H2750 pbinns on DSKJLVW7X2PROD with $$_JOB
