A BILL
To amend the Richard B. Russell National School Lunch
Act to establish a waiver under such Act to address
certain school closures, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘School Meals during
4
School Closures Act’’.

SEC. 2. WAIVER EXCEPTION FOR CERTAIN SCHOOL CLO-

SURES.

Section 12 of the Richard B. Russell National School
3
Lunch Act (42 U.S.C. 1760) is amended by inserting after
4
subsection (j) the following:
5
‘‘(k) WAIVER EXCEPTION
FOR CERTAIN SCHOOL
6
CLOSURES.—
7
‘‘(1) IN GENERAL.—The Secretary may waive
8
any requirement under this Act or the Child Nutri-
9
tion Act of 1966 (42 U.S.C. 1771 et seq.), or any
10
regulation issued under either such Act, for a State
11
or eligible service provider that requests a waiver to
12
provide meals and meal supplements under such
13
Acts during a school closure due to—
14
‘‘(A) a strike or other labor-management
15
dispute (except a waiver shall not apply in the
16
case of a lockout by an employer);
17
‘‘(B) inclement weather, a natural disaster,
18
a public health emergency, unsafe facilities,
19
construction, or repairs; or
20
‘‘(C) an unanticipated event that the Sec-
21
retary determines appropriate.

‘‘(2) REQUIREMENTS.—

‘‘(A) IN GENERAL.—Except as provided in
24
subparagraph (B), the requirements applicable

to a waiver under subsection (l) shall apply to

a waiver under this subsection.

‘‘(B)
EXCEPTIONS.—Paragraphs
3
(1)(A)(iii), (4), and (5) of subsection (l) shall
4
not apply to a waiver under this subsection.’’.
