To amend title 46, United States Code, to allow the Federal Maritime Com-
mission to provide injunctive relief without a court order, and for other
purposes.

Mr. GARAMENDI introduced the following bill; which was referred to the Com-
mittee on Transportation and Infrastructure, and in addition to the Com-
mittee on the Judiciary, for a period to be subsequently determined by
the Speaker, in each case for consideration of such provisions as fall with-
in the jurisdiction of the committee concerned
A BILL
To amend title 46, United States Code, to allow the Federal
Maritime Commission to provide injunctive relief without
a court order, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Ocean Shipping Com-
4
petition Enforcement Act’’.
5
SEC. 2. INJUNCTIVE RELIEF BY THE COMMISSION.

(a) IN GENERAL.—Section 41307 of title 46, United
7
States Code, is amended—

(1) in the heading by striking ‘‘sought’’; and

(2) in subsection (b)—
2
(A) in paragraph (1) by striking ‘‘, may
3
bring a civil’’ and all that follows through the
4
period at the end of the sentence and inserting
5
‘‘and an opportunity to be heard under expe-
6
dited procedures established by the Commission
7
with due regard for confidential or proprietary
8
information, may enjoin the operation of the
9
agreement. An injunction under this paragraph
10
shall constitute a final order of the Commis-
11
sion.’’;

(B) by striking paragraphs (2) and (3) and
13
inserting the following:
14
‘‘(2) THIRD PARTY INTERVENTION.—The Com-
15
mission may allow a third party to intervene in a
16
proceeding before the Commission under this sub-
17
section.’’; and
18
(C) by redesignating paragraph (4) as
19
paragraph (3).

(b) CLERICAL AMENDMENT.—The item relating to
21
section 41307 in the analysis for chapter 413 of title 46,
22
United States Code, is amended by striking ‘‘sought’’.
