Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. PERMANENT RESIDENT STATUS FOR FELIPE 3 DIOSDADO. 4 (a) IN GENERAL.—Notwithstanding subsections (a) 5 and (b) of section 201 of the Immigration and Nationality 6 Act, Felipe Diosdado shall each be eligible for issuance 7 of an immigrant visa or for adjustment of status to that 8 of an alien lawfully admitted for permanent residence 9 upon filing an application for issuance of an immigrant 10 visa under section 204 of such Act or for adjustment of 11 status to lawful permanent resident. 12 VerDate Sep 11 2014 00:04 Apr 19, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2699.IH H2699 pbinns on DSKJLVW7X2PROD with $$_JOB 2 •HR 2699 IH (b) ADJUSTMENT OF STATUS.—If Felipe Diosdado 1 enters the United States before the filing deadline speci- 2 fied in subsection (c), such named individual shall be con- 3 sidered to have entered and remained lawfully and shall, 4 if otherwise eligible, be eligible for adjustment of status 5 under section 245 of the Immigration and Nationality Act 6 as of the date of the enactment of this Act. 7 (c) WAIVER OF GROUNDS FOR REMOVAL OR DENIAL 8 OF ADMISSION.— 9 (1) IN GENERAL.—Notwithstanding sections 10 212(a) and 237(a) of the Immigration and Nation- 11 ality Act, Felipe Diosdado may not be removed from 12 the United States, denied admission to the United 13 States, or considered ineligible for lawful permanent 14 residence in the United States by reason of any 15 ground for removal or denial of admission that is re- 16 flected in the records of the Department of Home- 17 land Security or the Visa Office of the Department 18 of State on the date of the enactment of this Act. 19 (2) RECESSION OF OUTSTANDING ORDER OF 20 REMOVAL.—The Secretary of Homeland Security 21 shall rescind any outstanding order of removal or de- 22 portation, or any finding of inadmissibility or de- 23 portability, that has been entered against Felipe 24 VerDate Sep 11 2014 00:04 Apr 19, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2699.IH H2699 pbinns on DSKJLVW7X2PROD with $$_JOB 3 •HR 2699 IH Diosdado by reason of any ground described in para- 1 graph (1). 2 (d) DEADLINE FOR APPLICATION AND PAYMENT OF 3 FEES.—Subsections (a) and (b) shall apply only if the ap- 4 plication for issuance of an immigrant visa or the applica- 5 tion for adjustment of status is filed with appropriate fees 6 within 2 years after the date of the enactment of this Act. 7 (e) REDUCTION OF IMMIGRANT VISA NUMBER.— 8 Upon the granting of an immigrant visa or permanent res- 9 idence to Felipe Diosdado, the Secretary of State shall in- 10 struct the proper officer to reduce by 1, during the current 11 or next following fiscal year, the total number of immi- 12 grant visas that are made available to natives of the coun- 13 try of the alien’s birth under section 203(a) of the Immi- 14 gration and Nationality Act or, if applicable, the total 15 number of immigrant visas that are made available to na- 16 tives of the country of the alien’s birth under section 17 202(e) of such Act. 18 (f) DENIAL OF PREFERENTIAL IMMIGRATION TREAT- 19 MENT FOR CERTAIN RELATIVES.—The natural parents, 20 brothers, and sisters of Felipe Diosdado shall not, by vir- 21 tue of such relationship, be accorded any right, privilege, 22 or status under the Immigration and Nationality Act. 23 Æ VerDate Sep 11 2014 00:04 Apr 19, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H2699.IH H2699 pbinns on DSKJLVW7X2PROD with $$_JOB
