A BILL
To direct the Secretary of State to submit to Congress a
report on the designation of MS–13, Queen Nation,
Sinaloa, Cartel Jalisco Nueva Generacio´n, and Beltra´n
Leyva Organization as foreign terrorist organizations,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Terrorist Organization
4
Classification Act of 2023’’.

SEC. 2. REPORT ON DESIGNATION OF CERTAIN DRUG CAR-

TELS AS FOREIGN TERRORIST ORGANIZA-
2
TIONS.

(a) SENSE OF CONGRESS.—It is the sense of Con-
4
gress that each of the drug cartels set forth in subsection
5
(b) meets the criteria for designation as a foreign terrorist
6
organization as set forth in section 219 of the Immigration
7
and Nationality Act (8 U.S.C. 1189).

(b) DESIGNATION.—The Secretary of State shall des-
9
ignate each of the following Mexican drug cartels as a for-
10
eign terrorist organization under such section 219:
11
(1) MS–13.
12
(2) Queen Nation.
13
(3) Sinaloa.
14
(4) Cartel Jalisco Nueva Generacio´n.
15
(5) Beltra´n Leyva Organization.

(c) REPORT.—

(1) REPORT
REQUIRED.—Not later than 30
18
days after the date of the enactment of this Act, the
19
Secretary of State, in consultation with the Director
20
of National Intelligence, shall submit to the appro-
21
priate committees of Congress—
22
(A) a detailed report on each of the drug
23
cartels listed in subsection (b) and any other
24
cartels the Secretary may identify, including the
25
criteria met for designation as a foreign ter-

rorist organization as set forth in section 219
1
of the Immigration and Nationality Act (8
2
U.S.C. 1189); and
3
(B) for each of the cartels designated
4
under subsection (b), if the Secretary deter-
5
mines that the drug cartel does not meet the
6
criteria set forth under such section 219, a de-
7
tailed justification as to which criteria have not
8
been met.

(2) DESIGNATION OF ADDITIONAL CARTELS.—
10
Not later than 30 days after the submission of the
11
report the Secretary shall designate any cartel or
12
any faction thereof as a foreign terrorist organiza-
13
tion listed in the report that met the criteria for des-
14
ignation as a foreign terrorist organization as set
15
forth in section 219 of the Immigration and Nation-
16
ality Act (8 U.S.C. 1189).
17
(3) FORM.—The report required by paragraph
18
(1) shall—
19
(A) be submitted in unclassified form, but
20
may include a classified annex; and
21
(B) be made available only in electronic
22
form and shall not be printed, except if a print-
23
ed copy is requested by an office of the legisla-
24
tive branch.

(4) APPROPRIATE COMMITTEES OF CONGRESS
1
DEFINED.—In this subsection, the term ‘‘appro-
2
priate committees of Congress’’ means—
3
(A) the Committee on Armed Services, the
4
Committee on Financial Services, the Com-
5
mittee on Foreign Affairs, the Committee on
6
the Judiciary, the Committee on Homeland Se-
7
curity, and the Permanent Select Committee on
8
Intelligence of the House of Representatives;
9
and
10
(B) the Committee on Armed Services, the
11
Committee on Banking, Housing, and Urban
12
Affairs, the Committee on Foreign Relations,
13
the Committee on the Judiciary, the Committee
14
on Homeland Security and Governmental Af-
15
fairs, and the Select Committee on Intelligence
16
of the Senate.
17
(d) RULE OF CONSTRUCTION.—Nothing in this Act
18
may be construed to expand the eligibility for asylum of
19
any alien by reason of the designation of a drug cartel
20
as a foreign terrorist organization.
