SHORT TITLE. 1 This Act may be cited as the ‘‘Protect Our Law en- 2 forcement with Immigration Control and Enforcement Act 3 of 2023’’ or the ‘‘POLICE Act of 2023’’. 4 SEC. 2. ASSAULT OF LAW ENFORCEMENT OFFICER. 5 Section 237(a)(2) of the Immigration and Nationality 6 Act (8 U.S.C. 1227(a)(2)) is amended by adding at the 7 end the following: 8 ‘‘(G) ASSAULT OF LAW ENFORCEMENT OF- 9 FICER.— 10 ‘‘(i) IN GENERAL.—Any alien who has 11 been convicted of, who admits having com- 12 mitted, or who admits committing acts 13 which constitute the essential elements of, 14 any offense involving assault of a law en- 15 forcement officer is deportable. 16 ‘‘(ii) CIRCUMSTANCES.—The cir- 17 cumstances referred to in clause (i) are 18 that the law enforcement officer was as- 19 saulted— 20 ‘‘(I) while he or she was engaged 21 in the performance of his or her offi- 22 cial duties; 23 ‘‘(II) because of the performance 24 of his or her official duties; or 25 VerDate Sep 11 2014 23:43 May 18, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2494.RFS H2494 kjohnson on DSK79L0C42PROD with BILLS 3 HR 2494 RFS ‘‘(III) because of his or her sta- 1 tus as a law enforcement officer. 2 ‘‘(iii) DEFINITIONS.—In this subpara- 3 graph— 4 ‘‘(I) the term ‘assault’ has the 5 meaning given that term in the juris- 6 diction where the act occurred; and 7 ‘‘(II) the term ‘law enforcement 8 officer’ is a person authorized by 9 law— 10 ‘‘(aa) to apprehend, arrest, 11 or prosecute an individual for 12 any criminal violation of law; or 13 ‘‘(bb) to be a firefighter or 14 other first responder.’’. 15 SEC. 3.
