To amend the Helium Act to ensure continued access to
helium for holders of Federal research grants, and for
other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ββSecuring Helium for
4
Science Act of 2020ββ.
5
SEC. 2. SALE OF CRUDE HELIUM.
6
(a) IN GENERAL.βSection 6 of the Helium Act (50
7
U.S.C. 167d) is amendedβ

(1) in subsection (d)β

ββ(5) RESPONSIBILITIES OF PURCHASER.βThe

Secretary may not sell the Federal Helium Reserve

unless the purchaser agrees to be subject to the

same requirements as the Secretary under sub-

section (e), except that such requirements shall not
10
terminate until the end of the 8 year period de-
11
scribed in subsection (e)(1).ββ;

(2) by redesignating subsections (e) and (f) as
13
subsections (f) and (g) respectively; and
14
(3) by inserting the following after subsection
15
(d):

ββ(e) PHASE E: CONTINUED ACCESS FOR RESEARCH-

ERS.β

ββ(1) IN GENERAL.βExcept as provided in para-
19
graph (3), during the 8 year period beginning on the
20
earlier of September 30, 2022 or the date on which
21
the Secretary ends sales of helium under subsection
22
(c), the Secretary shall offer crude helium for sale
23
to holders of a Federal research grant in quantities
24
not to exceed 30 million cubic feet of crude helium

annually, at such times and under such terms and

conditions as the Secretary determines appropriate.

ββ(2) PRICE.β
3
ββ(A) FIRST YEAR.βDuring the one year
4
period beginning on the date of the first sale of
5
helium under paragraph (1), the price of helium
6
sold under such paragraph shall be 5 percent
7
higher than the price of the most recent sale of
8
helium under subsection (c).
9
ββ(B) SUBSEQUENT YEARS.βThe Secretary
10
shall increase the price of helium offered under
11
this paragraph by 5 percent in each subsequent
12
year in which sales occur under this subsection.
13
ββ(3) TERMINATION.βThe requirements of this
14
subsection shall not apply to the Secretary beginning
15
on the date that a purchaser of the Federal Helium
16
Reserve that has agreed to be subject to the require-
17
ments of this subsection assumes control of such
18
Federal Helium Reserve.ββ.

(b) CONFORMING AMENDMENT.βSection 3(c) of the
20
Helium Act (50 U.S.C. 167a(c)) is amended by striking
21
ββ6(e)ββ and inserting ββ6(f)ββ.
