and for other purposes.

A BILL
To amend the Food and Nutrition Act of 2008 to modify
the definition of a household under the supplemental
nutrition assistance program, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Supportive Living
4
Food Access Protection Act of 2020’’.
5
SEC. 2. DEFINITIONS OF FOOD AND HOUSEHOLD.

Section 3 of the Food and Nutrition Act of 2008 (7
7
U.S.C. 2012) is amended—

(1) in subsection (k)(3), by inserting ‘‘residen-
1
tial care settings provided funds by the appropriate
2
State agency under regulations issued under section
3
1915(c) of the Social Security Act (42 U.S.C.
4
1396n(c)),’’ before ‘‘public or private’’; and
5
(2) in subsection (m)(5), by adding at the end
6
the following:
7
‘‘(F)(i) Individuals who are 60 years of age
8
or over or who receive supplemental security in-
9
come benefits or disability or blindness pay-
10
ments under title I, II, X, XIV, or XVI of the
11
Social Security Act (42 U.S.C. 301 et seq.) who
12
reside in a residential care setting provided
13
funds by the appropriate State agency under
14
regulations issued under section 1915(c) of the
15
Social Security Act (42 U.S.C. 1396n(c)); and
16
‘‘(ii) the spouses of those individuals if the
17
spouse resides in a residential care setting de-
18
scribed in clause (i).’’.

SEC. 3. ISSUANCE AND USE OF PROGRAM BENEFITS.

Section 7(f)(2)(B)(ii) of the Food and Nutrition Act
21
of 2008 (7 U.S.C. 2016(f)(2)(B)(ii)) is amended by insert-
22
ing ‘‘and residential care settings provided funds by the
23
appropriate State agency under regulations issued under

section 1915(c) of the Social Security Act (42 U.S.C.

SEC. 4. REVIEW OF PROGRAM OPERATIONS.

(a) IN GENERAL.—Section 9(i)(2) of the Food and
4
Nutrition Act of 2008 (7 U.S.C. 2018(i)(2)) is amended
5
by striking ‘‘December 31, 2020’’ and inserting ‘‘the date
6
that is 1 year after the date of enactment of the Sup-
7
portive Living Food Access Protection Act of 2020’’.
8
(b) REGULATIONS.—The Secretary shall promulgate
9
any regulations necessary to carry out the amendment
10
made by subsection (a) not later than 1 year after the
11
date of enactment of this Act.
