A BILL
To amend the Homeland Security Act of 2002 to provide
for certain succession reforms, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SUCCESSION REFORMS.
3
Subsection (g) of section 103 of the Homeland Secu-
4
rity Act of 2002 (6 U.S.C. 113) is amended—
5
(1) in paragraph (1), by striking ‘‘neither the
6
Secretary nor Deputy Secretary is’’ and inserting
7
‘‘the Secretary, Deputy Secretary, and Associate
8
Secretary are not’’; and

order of succession to serve as Acting Secretary.’’

‘‘(A) such other official of the Department

in further order of succession to serve as Acting

Secretary in a manner that requires such offi-
7
cial to have served in the Department for at
8
least 90 days prior to such designation in either
9
the position of the head of a component or in
10
another position by and with the advice and
11
consent of the Senate, or in the event that an
12
official satisfying such criteria is not available,
13
in a manner that requires such official to have
14
served for at least 90 days prior to such des-
15
ignation in the Senior Executive Service in the
16
Department; and
17
‘‘(B) such other official of the Department
18
to serve as the acting head of a component in
19
the event the head of a component vacates the
20
position, in a manner that requires such official
21
to have served for at least 90 days prior to such
22
designation in the Senior Executive Service.’’.
