To provide that for purposes of determining compliance with title IX of
the Education Amendments of 1972 in athletics, sex shall be determined
on the basis of biological sex as determined at birth by a physician.

A BILL

title IX of the Education Amendments of 1972 in ath-

Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Protect Women’s
4
Sports Act of 2020’’.

SEC. 2. AMENDMENT.
1
Section 901 of the Education Amendments of 1972

(20 U.S.C. 1681(a)) is amended by adding at the end the
3
following:

‘‘(d) It shall be a violation of subsection (a) for a
5
recipient of Federal funds who operates, sponsors, or fa-
6
cilitates athletic programs or activities to permit a person
7
whose biological sex at birth is male to participate in an
8
athletic program or activity that is designated for women
9
or girls.’’.
