A BILL
To amend title XIX of the Social Security Act to provide
enhanced Federal matching payments for homecare
worker training programs, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Homecare Worker
4
Training Improvement Act of 2020’’.
5
SEC. 2. MEDICAID FUNDING FOR HOMECARE WORKER
6
TRAINING PROGRAMS.
7
Section 1903 of the Social Security Act (42 U.S.C.
8
1396b) is amended—

(1) in subsection (a)(2), by adding at the end
1
the following new subparagraph:
2
‘‘(F) for calendar quarters beginning on or
3
after January 1, 2021, amount equal to 75 percent
4
of so much of the sums expended during such quar-
5
ter for homecare worker training programs described
6
in subsection (bb) (including the costs for eligible
7
homecare workers (as defined in such subsection) to
8
complete such programs); plus’’; and
9
(2) by adding at the end the following new sub-
10
section:

‘‘(bb) HOMECARE WORKER TRAINING PROGRAMS.—
12
‘‘(1) IN GENERAL.—A homecare worker train-
13
ing program described in this subsection is a pro-
14
gram approved by the State under which eligible
15
homecare workers are provided with—
16
‘‘(A) training in the core training com-
17
petencies for personal or homecare aides de-
18
scribed in section 2008(b)(3)(A); and
19
‘‘(B) opportunities for education, training,
20
and career advancement.

‘‘(2) ELIGIBLE HOMECARE WORKER.—The term
22
‘eligible homecare worker’ means a personal or
23
homecare aide (as such term is defined in section
24
2008(b)(6)(C)) who—

‘‘(A) has at least 30 percent of the work-
1
er’s patient volume (as estimated in accordance
2
with a methodology established by the Sec-
3
retary) attributable to individuals who are re-
4
ceiving medical assistance under this title; or
5
‘‘(B) is employed by an agency that is a
6
provider of personal or homecare services that
7
has at least 30 percent of the agency’s patient
8
volume (as so estimated) attributable to such
9
individuals.’’.
