Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘ATVM Modernization 4 Act’’. 5 SEC. 2. ATVM MODERNIZATION. 6 (a) IN GENERAL.—Section 136(a)(1) of the Energy 7 Independence and Security Act of 2007 (42 U.S.C. 8 17013(a)) is amended by striking paragraph (1) and in- 9 serting the following: 10 VerDate Sep 11 2014 23:36 Dec 26, 2020 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H8933.IH H8933 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 8933 IH ‘‘(1) ADVANCED TECHNOLOGY VEHICLE.—The 1 term ‘advanced technology vehicle’ means— 2 ‘‘(A) an ultra efficient vehicle or a light 3 duty vehicle that meets— 4 ‘‘(i) the Bin 5 Tier II emission stand- 5 ard established in regulations issued by the 6 Administrator of the Environmental Pro- 7 tection Agency under section 202(i) of the 8 Clean Air Act (42 U.S.C. 7521(i)), or a 9 lower-numbered Bin emission standard; 10 ‘‘(ii) any new emission standard in ef- 11 fect for fine particulate matter prescribed 12 by the Administrator under that Act (42 13 U.S.C. 7401 et seq.); and 14 ‘‘(iii) at least 125 percent of the aver- 15 age base year combined fuel economy for 16 vehicles with substantially similar at- 17 tributes; or 18 ‘‘(B) an aircraft (as defined under section 19 40102 of title 49, United States Code) that 20 meets— 21 ‘‘(i) the appropriate and most recent 22 emission and fuel economy standards es- 23 tablished in regulations issued by the Ad- 24 ministrator of the Environmental Protec- 25 VerDate Sep 11 2014 23:36 Dec 26, 2020 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H8933.IH H8933 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 8933 IH tion Agency, in consultation with the Ad- 1 ministrator of the Federal Aviation Admin- 2 istration, under section 231(a) of the 3 Clean Air Act (42 U.S.C. 7571(a)); and 4 ‘‘(ii) at least 125 percent of the aver- 5 age base year fuel economy for aircraft 6 with substantially similar attributes.’’. 7 (b) RULEMAKING.—The Secretary of Energy shall 8 issue an interim final rulemaking updating the ‘‘Advanced 9 Technology Vehicles Manufacturing Incentive Program’’ 10 interim final rule (73 Fed.
