provision of compensation to personnel of the Central Intelligence Agency
who incur disabilities resulting from certain injuries to the brain, to
authorize the provision of compensation to personnel of the Department
of State who incur similar disabilities, and for other purposes.

TON) introduced the following bill; which was read twice and referred to
the Committee on Homeland Security and Governmental Affairs
A BILL
To amend the Central Intelligence Agency Act of 1949 to
authorize the provision of compensation to personnel of
the Central Intelligence Agency who incur disabilities
resulting from certain injuries to the brain, to authorize
the provision of compensation to personnel of the Depart-
ment of State who incur similar disabilities, and for
other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. AUTHORITY TO COMPENSATE PERSONNEL OF

CENTRAL INTELLIGENCE AGENCY FOR DIS-
2
ABILITIES RESULTING FROM CERTAIN INJU-
3
RIES TO THE BRAIN.
4
(a) DEFINITIONS.—In this section:
5
(1) CONGRESSIONAL
INTELLIGENCE
COMMIT-
6
TEES.—The term ‘‘congressional intelligence com-
7
mittees’’ has the meaning given such term in section
8
3 of the National Security Act of 1947 (50 U.S.C.
9
3003).

(2) COVERED
DEPENDENT,
COVERED
EM-
11
PLOYEE, COVERED
INDIVIDUAL, AND
QUALIFYING
12
INJURY.—The terms ‘‘covered dependent’’, ‘‘covered
13
employee’’, ‘‘covered individual’’, and ‘‘qualifying in-
14
jury’’ have the meanings given such terms in section
15
19A(a) of the Central Intelligence Agency Act of
16
1949 (50 U.S.C. 3519b(a)).
17
(b) COMPENSATION AUTHORIZED.—Section 19A of
18
the Central Intelligence Agency Act of 1949 (50 U.S.C.
19
3519b) is amended by adding at the end the following:
20
‘‘(d) AUTHORITY TO COMPENSATE
FOR DISABIL-
21
ITIES RESULTING FROM QUALIFYING INJURIES TO THE
22
BRAIN.—Notwithstanding any other provision of law, the
23
Director may provide compensation to a covered depend-
24
ent, a covered employee, and a covered individual who has
25
a partial or total disability—

‘‘(1) resulting from a qualifying injury to the
1
brain; and
2
‘‘(2) for which the covered dependent, covered
3
employee, or covered individual is not entitled to re-
4
ceive monthly compensation under section 8105 or
5
8106 of title 5, United States Code.’’.

(c) APPLICABILITY.—Subsection (d) of such section,
7
as added by subsection (b) of this section, shall apply with
8
respect to a disability resulting from a qualifying injury
9
that occurs before, on, or after the date of the enactment
10
of this Act.
11
(d) REPORT.—
12
(1) IN
GENERAL.—Not later than 180 days
13
after the date of the enactment of this Act, the Di-
14
rector of the Central Intelligence Agency shall sub-
15
mit to the congressional intelligence committees a
16
report on the use of the authority provided by sec-
17
tion 19A(d) of such Act, as added by subsection (b)
18
of this section.
19
(2) CONTENTS.—The report submitted under
20
paragraph (1) shall include the following:
21
(A) A budget for the use of the authority
22
described in paragraph (1).
23
(B) Information relating to the use of the
24
authority described in paragraph (1).

(C) An assessment of whether any other

legislative or administrative action is required
2
to ensure that covered dependents, covered em-
3
ployees, and covered individuals can receive
4
compensation for any disability resulting from a
5
qualifying injury, such as a qualifying injury to
6
the back or heart.

(3) CLASSIFIED ANNEX.—The report submitted
8
under paragraph (1) shall include a classified annex
9
that includes the budget and information included
10
under subparagraphs (A) and (B) of paragraph (2).
11
(e) CLARIFYING AMENDMENT.—Section 19A(b) of
12
the Central Intelligence Agency Act of 1949 (50 U.S.C.
13
3519b(b)) is amended, in the subsection heading, by in-
14
serting ‘‘TOTAL DISABILITY RESULTING FROM’’ before
15
‘‘CERTAIN INJURIES’’.

SEC. 2. AUTHORITY TO COMPENSATE PERSONNEL OF DE-
17
PARTMENT OF STATE FOR DISABILITIES RE-
18
SULTING FROM CERTAIN INJURIES TO THE
19
BRAIN.

Section 901 of title IX of division J of the Further
21
Consolidated Appropriations Act, 2020 (22 U.S.C. 2680b)
22
is amended—
23
(1) by redesignating subsections (c) through (h)
24
as subsections (d) through (i), respectively;

(2) by inserting after subsection (b) the fol-

lowing new subsection:

‘‘(c) OTHER INJURIES.—
3
‘‘(1) IN GENERAL.—Notwithstanding any other
4
provision of law, the Secretary of State or other
5
agency head with an employee abroad under Chief of
6
Mission authority may provide compensation to a
7
covered dependent, a covered employee, and a cov-
8
ered individual who has a partial or total dis-
9
ability—
10
‘‘(A) resulting from a qualifying injury to
11
the brain; and
12
‘‘(B) for which the covered dependent, cov-
13
ered employee, or covered individual is not enti-
14
tled to receive monthly compensation under sec-
15
tion 8105 or 8106 of title 5, United States
16
Code.
17
‘‘(2) REPORT.—Not later than 180 days after
18
the date of the enactment of this subsection, the
19
Secretary of State or other agency head with an em-
20
ployee abroad under Chief of Mission authority shall
21
submit to the Committee on Foreign Relations of
22
the Senate and the Committee on Foreign Affairs of
23
the House a report on the use of the authority pro-
24
vided by this subsection. The report shall include an

assessment of whether additional authorities are re-
1
quired to ensure that covered dependents, covered
2
employees, and covered individuals can receive com-
3
pensation for any disability resulting from a quali-
4
fying injury, such as a qualifying injury to the back
5
or neck.’’;
6
(3) in subsection (f), as redesignated by para-
7
graph (1)—
8
(A) by striking ‘‘subsection (f)’’ each place
9
it appears and inserting ‘‘subsection (g)’’;
10
(B) in paragraph (1), by striking ‘‘of a em-
11
ployee’’ and inserting ‘‘of an employee or
12
former employee’’; and
13
(C) in paragraph (2), by striking ‘‘means
14
an employee’’ and inserting ‘‘means an em-
15
ployee or former employee’’;
16
(4) in subsection (g), as redesignated by para-
17
graph (1), by striking ‘‘subsection (a) or (b)’’ both
18
places it appears and inserting ‘‘subsection (a), (b),
19
or (c)’’; and
20
(5) in subsection (i), as redesignated by para-
21
graph (1)—
22
(A) in paragraph (1), by striking ‘‘IN GEN-
