Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Apple Valley Off-High- 4 way Vehicle Recreation Area Establishment Act’’. 5 SEC. 2. CONVEYANCE FOR APPLE VALLEY OFF-HIGHWAY 6 VEHICLE RECREATION AREA. 7 (a) DEFINITIONS.—In this section: 8 (1) TOWN.—The term ‘‘Town’’ means the town 9 of Apple Valley, California. 10 VerDate Sep 11 2014 04:58 Dec 14, 2020 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H8850.IH H8850 pbinns on DSKJLVW7X2PROD with BILLS 2 •HR 8850 IH (2) SECRETARY.—The term ‘‘Secretary’’ means 1 the Secretary of the Interior. 2 (b) CONVEYANCE OF FEDERAL LAND TO TOWN.— 3 (1) CONVEYANCE REQUIRED.—Not later than 5 4 years after the date of the enactment of this Act, the 5 Secretary shall convey to the Town, without consid- 6 eration, all right, title, and interest of the United 7 States in and to the surface estate of approximately 8 4,630 acres of land generally as ‘‘Proposed Convey- 9 ance Area’’ on the entitled ‘‘Conveyance to the Town 10 of Apple Valley’’ and dated June 1, 2015. Such land 11 shall be known and designated as the ‘‘Apple Valley 12 Off-Highway Vehicle Recreation Area’’. 13 (2) EXISTING RIGHTS AND MINERAL ESTATE.— 14 The conveyance under this subsection— 15 (A) is subject to valid existing rights; and 16 (B) does not include the mineral estate. 17 (c) USE OF CONVEYED LAND.— 18 (1) IN GENERAL.—The land conveyed under 19 subsection (b) may be used by the Town for any 20 public purpose authorized in paragraph (2), con- 21 sistent with the Act of June 14, 1926 (commonly 22 known as the Recreation and Public Purposes Act; 23 43 U.S.C. 869 et seq.). 24 VerDate Sep 11 2014 04:58 Dec 14, 2020 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H8850.IH H8850 pbinns on DSKJLVW7X2PROD with BILLS 3 •HR 8850 IH (2) AUTHORIZED PURPOSES.—The purposes of 1 the conveyance under subsection (b) are to permit 2 the Town to use the conveyed land to provide— 3 (A) a suitable location for the establish- 4 ment of a centralized off-road vehicle recreation 5 park; 6 (B) the public with opportunities for off- 7 road vehicle recreation, including a location for 8 races, competitive events, training and other 9 commercial services that directly support a cen- 10 tralized off-road vehicle recreation area and 11 Town park; and 12 (C) a designated area and facilities that 13 would discourage unauthorized use of off-high- 14 way vehicles in areas that have been identified 15 by the Federal Government, the State of Cali- 16 fornia, or the County of San Bernardino as 17 containing environmentally sensitive land. 18 (3) DISPOSAL PROHIBITED.—The land con- 19 veyed under subsection (b) may not be disposed of 20 by the Town without the approval of the Secretary 21 of the Interior. 22 (d) TEMPORARY REVERSIONARY INTEREST.—During 23 the 5-year period beginning on the date of the conveyance 24 of the land under subsection (b), if the Secretary of the 25 VerDate Sep 11 2014 04:58 Dec 14, 2020 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H8850.IH H8850 pbinns on DSKJLVW7X2PROD with BILLS 4 •HR 8850 IH Interior determines that the Town has disposed of the con- 1 veyed land in violation of subsection (c)(3) or has failed 2 to establish the off-road vehicle recreation park, title to 3 the land shall revert to the United States, at the option 4 of the Secretary.
