REQUIRING STATES TO OBTAIN INFORMATION 1 FROM SOCIAL SECURITY ADMINISTRATION 2 ON DEATHS FOR PURPOSES OF VOTER REG- 3 ISTRATION LIST MAINTENANCE. 4 (a) IN GENERAL.—Section 8(a)(4)(A) of the Na- 5 tional Voter Registration Act of 1993 (52 U.S.C. 6 20507(a)(4)(A)) is amended to read as follows: 7 ‘‘(A) the death of the registrant, as deter- 8 mined on the basis of information obtained 9 through records of the State and of information 10 obtained through ongoing consultation with the 11 Social Security Administration; or’’. 12 (b) AUTHORITY TO MATCH DATA.—Section 205(r) 13 of the Social Security Act (42 U.S.C. 405(r)) is amended 14 by adding at the end the following: 15 ‘‘(10) The Commissioner of Social Security shall, 16 upon the request of a State pursuant to section 8(a)(4)(A) 17 of the National Voter Registration Act of 1993— 18 ‘‘(A) enter into an agreement with the State for 19 the purpose of matching data in the records of the 20 Social Security Administration and the official list of 21 eligible voters of the State; and 22 ‘‘(B) include in such agreement safeguards to 23 assure the maintenance of the confidentiality of any 24 information disclosed.’’. 25 (c) ANNUAL CERTIFICATION; ENFORCEMENT.— 26 VerDate Sep 11 2014 22:09 Dec 10, 2020 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H8830.IH H8830 pbinns on DSKJLVW7X2PROD with BILLS 3 •HR 8830 IH (1) CERTIFICATION.—Each State shall certify, 1 with respect to each calendar year, to the Secretary 2 of Education and the Secretary of Transportation 3 that the State has in place an agreement with the 4 Social Security Administration to share death infor- 5 mation for purposes of section 8(a)(4)(A) of the Na- 6 tional Voter Registration Act of 1993. 7 (2) PENALTIES FOR NONCOMPLIANCE.—With 8 respect to any calendar year in which a State has 9 failed to so certify, the Secretaries of Education and 10 Transportation may not make available any Federal 11 funds to the State, any county within the State, or 12 any resident of the State. 13 (d) DEFINITIONS.—In this section— 14 (1) the term ‘‘State’’ means a State of the 15 United States and the District of Columbia; and 16 (2) the term ‘‘county’’ means a parish in Lou- 17 isiana, a borough in Alaska, or a county in the other 18 48 States. 19 (e) EFFECTIVE DATE.—The amendments made by 20 this section shall take effect 1 year after the date of enact- 21 ment of this Act. 22 Æ VerDate Sep 11 2014 22:09 Dec 10, 2020 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H8830.IH H8830 pbinns on DSKJLVW7X2PROD with BILLS
