Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. PROVIDING ACCESS TO TRIBAL HEALTH, WELL- 1 BEING, AND YOUTH SAFETY PROGRAM. 2 (a) IN GENERAL.—Chapter 2 of title 23, United 3 States Code, is amended by inserting after section 207 the 4 following: 5 ‘‘§ 208. Providing Access to Tribal Health, Well-being, 6 and Youth Safety program 7 ‘‘(a) DEFINITIONS.—In this section: 8 ‘‘(1) INDIAN TRIBE.—The term ‘Indian tribe’ 9 has the meaning given the term in section 10 207(m)(1). 11 ‘‘(2) PROGRAM.—The term ‘program’ means 12 the Providing Access to Tribal Health, Well-being, 13 and Youth Safety program established under sub- 14 section (b). 15 ‘‘(b) ESTABLISHMENT.—The Secretary shall carry 16 out a grant program, to be known as the ‘Providing Access 17 to Tribal Health, Well-being, and Youth Safety program’ 18 or the ‘PATHWAYS program’ to provide grants to Indian 19 tribes to carry out eligible activities described in sub- 20 section (d). 21 ‘‘(c) APPLICATION.—To be eligible to receive a grant 22 under the program, an Indian tribe shall submit to the 23 Secretary an application at such time, in such manner, 24 and containing such information as the Secretary may re- 25 quire. 26 VerDate Sep 11 2014 04:39 Nov 24, 2020 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S4914.IS S4914 pbinns on DSKJLVW7X2PROD with BILLS 3 •S 4914 IS ‘‘(d) ELIGIBLE ACTIVITIES.—An Indian tribe may 1 use funds from a grant under the program to carry out 2 any of the following activities: 3 ‘‘(1) Construction, planning, and design of on- 4 road and off-road trail facilities for pedestrians, 5 bicyclists, and other nonmotorized forms of trans- 6 portation, including sidewalks, bicycle infrastructure, 7 pedestrian and bicycle signals, traffic calming tech- 8 niques, lighting and other safety-related infrastruc- 9 ture, and transportation projects to achieve compli- 10 ance with the Americans with Disabilities Act of 11 1990 (42 U.S.C. 12101 et seq.). 12 ‘‘(2) Construction, planning, and design of in- 13 frastructure-related projects and systems that will 14 provide safe routes for non-drivers, including chil- 15 dren, older adults, and individuals with disabilities, 16 to access daily needs. 17 ‘‘(3) Conversion and use of abandoned railroad 18 corridors for trails for pedestrians, bicyclists, or 19 other nonmotorized transportation users. 20 ‘‘(4) Construction of turnouts, overlooks, and 21 viewing areas. 22 ‘‘(5) Community improvement activities, includ- 23 ing— 24 VerDate Sep 11 2014 04:39 Nov 24, 2020 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S4914.IS S4914 pbinns on DSKJLVW7X2PROD with BILLS 4 •S 4914 IS ‘‘(A) historic preservation and rehabilita- 1 tion of historic transportation facilities; and 2 ‘‘(B) vegetation management practices in 3 transportation rights-of-way to improve road- 4 way safety, prevent against invasive species, or 5 provide erosion control. 6 ‘‘(6) Construction, planning, and design of in- 7 frastructure-related projects that— 8 ‘‘(A) will substantially improve the ability 9 of students to walk and bicycle to school, in- 10 cluding sidewalk improvements, traffic calming 11 and speed reduction improvements, pedestrian 12 and bicycle crossing improvements, on-street bi- 13 cycle facilities, and traffic diversion improve- 14 ments; and 15 ‘‘(B) are on a public road or any bicycle or 16 pedestrian pathway or trail in the vicinity of a 17 school. 18 ‘‘(7) Noninfrastructure-related activities to en- 19 courage walking and bicycling to school, including— 20 ‘‘(A) public awareness campaigns and out- 21 reach to press and community leaders; 22 ‘‘(B) student sessions on bicycle and pedes- 23 trian safety, health, and environment; and 24 VerDate Sep 11 2014 04:39 Nov 24, 2020 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S4914.IS S4914 pbinns on DSKJLVW7X2PROD with BILLS 5 •S 4914 IS ‘‘(C) funding for training, volunteers, and 1 managers of safe routes to school programs. 2 ‘‘(e) FEDERAL SHARE.—The Federal share of the 3 cost of an activity carried out with funds from a grant 4 under the program shall be 100 percent. 5 ‘‘(f) AUTHORIZATION OF APPROPRIATIONS.—There 6 is authorized to be appropriated out of the Highway Trust 7 Fund (other than the Mass Transit Account) $25,000,000 8 for each of fiscal years 2021 through 2025.’’. 9 (b) CONFORMING AMENDMENT.—Section 201(b)(1) 10 of title 23, United States Code, is amended by striking 11 ‘‘and the Federal lands access program’’ and inserting ‘‘, 12 the Federal lands access program, and the Providing Ac- 13 cess to Tribal Health, Well-being, and Youth Safety pro- 14 gram under section 208’’. 15 (c) CLERICAL AMENDMENT.—The analysis for chap- 16 ter 2 of title 23, United States Code, is amended by insert- 17 ing after the item relating to section 207 the following: 18 ‘‘208. Providing Access to Tribal Health, Well-being, and Youth Safety pro- gram.’’.
