INFORMATION COLLECTION AND DISSEMINATION. 1 The Secretary of Labor shall provide for data collec- 2 tion and dissemination of information regarding programs 3 under the national apprenticeship system, including— 4 (1) not later than 1 year after the date of the 5 enactment of this Act, establishing and supporting a 6 single information technology infrastructure to sup- 7 port data collection and reporting from State Ap- 8 prenticeship Agencies, State Offices of Apprentice- 9 ship, grantees, program sponsors, and program ad- 10 ministrators under the national apprenticeship sys- 11 tem by providing for a data infrastructure that— 12 (A) is developed and maintained by the 13 Secretary, with input from national data and 14 privacy experts, is informed by best practices on 15 public provision of credential information, and 16 to the extent practicable, aligns with the tech- 17 nology infrastructure for related Federal pro- 18 grams, such as the technology infrastructure 19 used under the Workforce Innovation and Op- 20 portunity Act (29 U.S.C. 3101 et seq.); 21 (B) best meets the needs of the national 22 apprenticeship system stakeholders reporting 23 data to the Secretary or State Apprenticeship 24 Agencies, including through the provision of 25 technical assistance and financial assistance as 26 VerDate Sep 11 2014 04:49 Nov 28, 2020 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H8766.IH H8766 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 8766 IH necessary to ensure reporting systems are 1 equipped to report into a single information 2 technology infrastructure; and 3 (C) is aligned with data from the perform- 4 ance data as required by the Secretary; and 5 (2) providing for data sharing that includes 6 making nonpersonally identifiable apprenticeship 7 data available on a publicly accessible website that 8 is searchable and comparable, through the use of 9 common, linked, open-data description language, 10 such as the credential transparency description lan- 11 guage or a substantially similar resource, so that in- 12 terested parties can become aware of apprenticeship 13 opportunities and of program outcomes that best 14 meets the needs of youth apprentices, pre-appren- 15 tices, and apprentices, employers, education and 16 training providers, program sponsors, and relevant 17 stakeholders, including— 18 (A) information on program offerings 19 under the national apprenticeship system based 20 on geographical location and apprenticeable oc- 21 cupation; 22 (B) information on education and training 23 providers providing opportunities under such 24 system, including whether programs under such 25 VerDate Sep 11 2014 04:49 Nov 28, 2020 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H8766.IH H8766 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 8766 IH system offer dual or concurrent enrollment pro- 1 grams, articulation agreements, and recognized 2 postsecondary credentials as part of the pro- 3 gram offerings; 4 (C) information about the educational and 5 occupational credentials and related com- 6 petencies of programs under such system; and 7 (D) information based on the most recent 8 data available to the Secretary that is con- 9 sistent with national standards and practices. 10 SEC. 3. DEFINITIONS. 11 In this Act: 12 (1) APPRENTICESHIP.—The term ‘‘apprentice- 13 ship’’ or ‘‘apprenticeship program’’ means an ap- 14 prenticeship— 15 (A) registered with the Department of 16 Labor under the Act of August 16, 1937 (com- 17 monly known as the ‘‘National Apprenticeship 18 Act’’; 50 Stat. 664, chapter 663; 29 U.S.C. 50 19 et seq.), or State Apprenticeship Agency recog- 20 nized by the Department of Labor; and 21 (B) that complies with the requirements of 22 subpart A of part 29, and part 30 of title 29, 23 Code of Federal Regulations (as in effect on 24 September 18, 2020). 25 VerDate Sep 11 2014 23:54 Dec 01, 2020 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H8766.IH H8766 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 8766 IH (2) NATIONAL APPRENTICESHIP SYSTEM.—The 1 term ‘‘national apprenticeship system’’ means the 2 apprenticeship programs, youth apprenticeship pro- 3 grams, and pre-apprenticeship programs registered 4 under the Act of August 16, 1937 (commonly re- 5 ferred to as the National Apprenticeship Act). 6 (3) RECOGNIZED POSTSECONDARY CREDEN- 7 TIAL.—The term ‘‘recognized postsecondary creden- 8 tial’’ has the meaning given the term in section 3 of 9 the Workforce Innovation and Opportunity Act (29 10 U.S.C. 3102), except that such term does not in- 11 clude a certificate of completion of an apprentice- 12 ship. 13 (4) SECRETARY.—The term ‘‘Secretary’’ means 14 the Secretary of Labor. 15 SEC. 4.
