A BILL
To direct the Secretary of Veterans Affairs to provide certain
notice to a person filing a claim against the Department
of Veterans Affairs for damage, injury, or death on
Standard Form 95, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Brian Tally VA Em-
4
ployment Transparency Act of 2020’’.

SEC. 2. DEPARTMENT OF VETERANS AFFAIRS REQUIRE-

MENT TO PROVIDE CERTAIN NOTICE TO PER-
2
SONS FILING CLAIMS FOR DAMAGE, INJURY,
3
OR DEATH ON STANDARD FORM 95.

Not later than 30 days after the date on which a per-
5
son submits to the Secretary of Veterans Affairs a claim
6
for damage, injury, or death on Standard Form 95, or
7
any successor form, the Secretary shall provide to the
8
claimant notice of each of the following:
9
(1) The importance of obtaining legal advice,
10
including a recommendation that the claimant
11
should secure legal counsel.
12
(2) The employment status of any individual
13
listed on the form.
14
(3) If the claim involves a contractor that en-
15
tered into an agreement with the Secretary, the im-
16
portance of obtaining legal advice as to the statute
17
of limitations regarding the claim in the State in
18
which the claim arose.
