SHORT TITLE. 1 This Act may be cited as the ‘‘Analyzing Kinetic Im- 2 pact Projectiles Against Americans Act of 2020’’. 3 SEC. 2. STUDY ON HEALTH CARE IMPACTS OF THE USE OF 4 KINETIC IMPACT PROJECTILES IN THE 5 UNITED STATES. 6 (a) IN GENERAL.—Not later than 30 days after the 7 date of the enactment of this Act, the Secretary of Health 8 and Human Services shall enter into an arrangement with 9 the National Academies of Sciences, Engineering, and 10 Medicine (or, if the National Academies decline to enter 11 into such arrangement, another appropriate entity) under 12 which, not later than 1 year after such date of enactment, 13 the National Academies (or other appropriate entity) will 14 complete a comprehensive study on the health care im- 15 pacts of the use of kinetic impact projectiles in the United 16 States. 17 (b) REQUIRED ANALYSIS.—The study conducted pur- 18 suant to subsection (a) shall include an analysis of each 19 of the following: 20 (1) The frequency and severity of injuries and 21 health impacts caused by the use of kinetic impact 22 projectiles on individuals domestically. 23 (2) The settings related to the use of kinetic 24 impact projectiles. 25 VerDate Sep 11 2014 19:00 Nov 20, 2020 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H8709.IH H8709 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 8709 IH (3) A statistical review of the frequency of use 1 of kinetic impact projectiles by law enforcement enti- 2 ties domestically. 3 (4) A demographic and racial breakdown of in- 4 dividuals who have been impacted by kinetic impact 5 projectile-caused injuries domestically. 6 (5) A statistical review of the site and mor- 7 bidity of injuries caused by kinetic impact projec- 8 tiles. 9 (6) A review of treatments for kinetic impact 10 projectile-caused injuries and the efficacy of such 11 treatments. 12 (c) REPORT TO CONGRESS.—The arrangement under 13 subsection (a) shall provide for the National Academies 14 of Sciences, Engineering, and Medicine (or other appro- 15 priate entity), not later than 6 months after the comple- 16 tion of the study conducted pursuant to subsection (a), 17 and annually thereafter— 18 (1) to submit to the relevant congressional com- 19 mittees of jurisdiction, including the Committees on 20 Appropriations, Energy and Commerce, and the Ju- 21 diciary of the House of Representatives and the 22 Committees on Appropriations; Health, Education, 23 Labor, and Pensions; and the Judiciary of the Sen- 24 ate, a report that contains— 25 VerDate Sep 11 2014 19:00 Nov 20, 2020 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H8709.IH H8709 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 8709 IH (A) the results of the analysis conducted 1 under subsection (b); and 2 (B) any recommendations, regarding the 3 effects of the use of kinetic impact projectiles in 4 the United States, to— 5 (i) implement changes government- 6 wide; 7 (ii) establish guidelines and best prac- 8 tices for the use of kinetic impact projec- 9 tiles; and 10 (iii) improve the oversight of Federal 11 procurement and funding for kinetic im- 12 pact projectiles; and 13 (2) to make such report publicly available on 14 the internet. 15 (d) DEFINITION.—In this section, the term ‘‘kinetic 16 impact projectile’’ means— 17 (1) a rubber or plastic bullet, bean bag round, 18 sponge round, pellet round, or wooden dowel; and 19 (2) any other projectile-delivered impact muni- 20 tion determined to be subject to the study under this 21 section by the Secretary of Health and Human Serv- 22 ices in consultation with the National Academies of 23 Sciences, Engineering, and Medicine (or other ap- 24 propriate entity). 25 VerDate Sep 11 2014 19:00 Nov 20, 2020 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H8709.IH H8709 pamtmann on DSKBC07HB2PROD with BILLS 5 •HR 8709 IH (e) AUTHORIZATION OF APPROPRIATIONS.—There is 1 authorized to be appropriated to carry out this Act 2 $2,000,000 for fiscal year 2021. 3 Æ VerDate Sep 11 2014 19:00 Nov 20, 2020 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H8709.IH H8709 pamtmann on DSKBC07HB2PROD with BILLS
