Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. FLEXIBLE USE OF SUBGRANT FUNDS. 1 Notwithstanding each provision in part B of title IV 2 of the Elementary and Secondary Education Act of 1965 3 (20 U.S.C. 7171 et seq.) that requires activities under 4 such part to be carried out during nonschool hours or peri- 5 ods when school is not in session, for the period under 6 which a public health emergency declared by the Secretary 7 of Health and Human Services under section 319 of the 8 Public Health Service Act (42 U.S.C. 247d) on January 9 31, 2020, with respect to COVID–19 is in effect or until 10 June 30, 2022, whichever is later, an eligible entity that 11 is awarded a subgrant under section 4204 of such Act (20 12 U.S.C. 7174) for community learning centers may use 13 such subgrant funds to carry out activities described in 14 section 4205 of such Act (20 U.S.C. 7175)— 15 (1) during the regular school day for students 16 eligible to receive services under part B of title IV 17 of such Act (20 U.S.C. 7171 et seq.) when the stu- 18 dent is not receiving full-time in-person instruction; 19 (2) regardless of whether such activities are 20 conducted in person or virtually; and 21 (3) if such activities supplement but do not sup- 22 plant regular school day instruction. 23 SEC. 3. APPLICATION TO PROVIDE SERVICES DURING THE 9 SCHOOL DAY. 10 An eligible entity that seeks to provide services pursu- 11 ant to the authority under this Act shall submit to the 12 State educational agency in such form as shall be re- 13 quired, an addendum to the eligible entity’s application 14 submitted under section 4204(b) of the Elementary and 15 Secondary Education Act of 1965 (20 U.S.C. 7174(b))— 16 (1) specifying how the subgrant funds and any 17 additional funds to be awarded will be used to carry 18 out the activities described in section 4205 of the El- 19 ementary and Secondary Education Act of 1965 (20 20 U.S.C. 7175); and 21 (2) describing how the eligible entity will com- 22 ply with section 3 of this Act. 23 VerDate Sep 11 2014 18:49 Nov 03, 2020 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S4868.IS S4868 pamtmann on DSKBC07HB2PROD with BILLS 4 •S 4868 IS SEC. 5.
