To amend title XIX of the Social Security Act to sunset
the increased FMAP for medical assistance for newly
eligible mandatory individuals, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Restoring Fairness to
4
Medicaid Reimbursement Act of 2020’’.

SEC. 2. SUNSET OF INCREASED FMAP FOR MEDICAL AS-

SISTANCE FOR NEWLY ELIGIBLE MANDA-
2
TORY INDIVIDUALS.

Section 1905(y)(1) of the Social Security Act (42
4
U.S.C. 1396 (y)(1)) is amended—
5
(1) in subparagraph (D), by striking at the end
6
‘‘and’’;
7
(2) in subparagraph (E), by striking ‘‘and each
8
year thereafter.’’ and inserting ‘‘; and’’; and
9
(3) by adding at the end the following new sub-
10
paragraph:

‘‘(F) the Federal medical assistance per-
12
centage otherwise provided under subsection (b)
13
for calendar quarters in 2021 and each year
14
thereafter.’’.

SEC. 3. CONFORMING OF TITLE XIX OF THE SOCIAL SECU-
16
RITY ACT TO PROVIDE A STATE OPTION TO
17
PROVIDE MEDICAL ASSISTANCE TO EXPAN-
18
SION POPULATION.

Section 1902(a)(10)(i)(VIII) of the Social Security
20
Act (42 U.S.C. 1396a(a)(10)(i)(VIII)) is amended by in-
21
serting ‘‘at the option of the State’’ after ‘‘beginning Jan-
22
uary 1, 2014,’’.
