DEFINITIONS. 1 In this Act: 2 (1) MANAGEMENT COUNCIL.—The term ‘‘Man- 3 agement Council’’ means the council established 4 under section 10. 5 (2) SECRETARY.—The term ‘‘Secretary’’ means 6 the Secretary of the Interior. 7 SEC. 4. ESTABLISHMENT OF ESCALANTE CANYONS NA- 8 TIONAL PARK AND PRESERVE. 9 (a) ESTABLISHMENT.—There is hereby established 10 within the Escalante Canyons National Monument the 11 ‘‘Escalante Canyons National Park and Preserve’’ in the 12 State of Utah. 13 (b) BOUNDARIES.—The boundaries of Escalante 14 Canyons National Park and Preserve are as generally de- 15 picted on the map entitled ‘‘llll’’, numbered 16 lll, and dated llll. WITHDRAWALS. 9 Subject to valid existing rights, any Federal land 10 within the Escalante Canyons National Park and Pre- 11 serve, including any land or interest in land that is ac- 12 quired by the United States after the date of enactment 13 of this Act, is withdrawn from— 14 (1) entry, appropriation, or disposal under the 15 public land laws; 16 (2) location, entry, and patent under the mining 17 laws; and 18 (3) operation of the mineral leasing, mineral 19 materials, and geothermal leasing laws. 20 SEC. 6. MAP AND LEGAL DESCRIPTION. 21 (a) IN GENERAL.—As soon as practicable after the 22 date of the enactment of this Act, the Secretary shall sub- 23 mit to the Committee on Natural Resources of the House 24 of Representatives and the Committee on Energy and 25 VerDate Sep 11 2014 22:57 Oct 26, 2020 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H8446.IH H8446 jbell on DSKJLSW7X2PROD with BILLS 4 •HR 8446 IH Natural Resources of the Senate a map and legal descrip- 1 tion of the Escalante Canyons National Park and Pre- 2 serve. 3 (b) FORCE AND EFFECT.—The map and legal de- 4 scription submitted under this section shall have the same 5 force and effect as if included in this Act, except that the 6 Secretary may make minor modifications of any clerical 7 or typographical errors in the map or legal description 8 provided these changes are first reported to the State of 9 Utah, Garfield and Kane Counties in Utah, and the Man- 10 agement Council. 11 SEC. 7. GRAND STAIRCASE NATIONAL MONUMENT. 12 (a) ESTABLISHMENT.—Subject to valid existing 13 rights, the Federal land comprising approximately 14 211,983 acres, identified as ‘‘Grand Staircase Unit’’ and 15 generally depicted on the map entitled ‘‘Grand Staircase- 16 Escalante National Monument Modification’’ is hereby es- 17 tablished as the ‘‘Grand Staircase National Monument’’. 18 (b) PURPOSE.—The purpose of the Grand Staircase 19 National Monument shall be to protect, conserve, and en- 20 hance the monument’s— 21 (1) unique and nationally important historic, 22 scenic, and natural resources; 23 (2) recreation, including hunting; and 24 (3) grazing. 25 VerDate Sep 11 2014 22:57 Oct 26, 2020 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H8446.IH H8446 jbell on DSKJLSW7X2PROD with BILLS 5 •HR 8446 IH (c) MAP.— 1 (1) As soon as practicable after the date of the 2 enactment of this Act, the Secretary shall submit to 3 the Committee on Natural Resources of the House 4 of Representatives and the Committee on Energy 5 and Natural Resources of the Senate a map and 6 legal description of the Grand Staircase National 7 Monument established in this section. 8 (2) The map and legal description submitted 9 under this section shall have the same force and ef- 10 fect as if included in this title, except that the Sec- 11 retary may make minor modification of any clerical 12 or typographical errors in the map or legal descrip- 13 tion provided these changes are first reported to the 14 State of Utah, Kane County, Utah, and the Manage- 15 ment Council. 16 (3) A copy of the map and legal description 17 shall be on file and available for public inspection in 18 the appropriate field offices of the Bureau of Land 19 Management. 20 SEC. 8. ESCALANTE CANYONS NATIONAL PARK AND PRE- 15 SERVE, GRAND STAIRCASE NATIONAL MONU- 16 MENT, KAIPAROWITS NATIONAL MONUMENT, 17 AND ESCALANTE CANYONS NATIONAL MONU- 18 MENT MANAGEMENT COUNCIL. 19 (a) ESTABLISHMENT.—The Management Council is 20 hereby established. 21 (b) DUTIES.—The Management Council shall develop 22 and implement the comprehensive management plans for 23 the Escalante Canyons National Park and Preserve, the 24 Grand Staircase National Monument, the Kaiparowits Na- 25 VerDate Sep 11 2014 22:57 Oct 26, 2020 Jkt 019200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H8446.IH H8446 jbell on DSKJLSW7X2PROD with BILLS 9 •HR 8446 IH tional Monument, and the Escalante Canyons National 1 Monument consistently with the purposes of those areas 2 as provided in this Act. 3 (c) MEMBERSHIP.—The Management Council shall 4 be composed of 7 members appointed not later than 180 5 days after the date of the enactment of this Act as follows: 6 (1) One individual from the Department of In- 7 terior, appointed by the President. 8 (2) Five individuals, appointed by the President 9 in consultation with the Congressional delegation 10 from the State of Utah and the Governor of Utah, 11 who shall represent the following: 12 (A) Two from the Garfield County, Utah, 13 Board of Commissioners. 14 (B) Two from the Kane County, Utah, 15 Board of Commissioners. 16 (C) One Utah State Legislator rep- 17 resenting Kane County, Garfield County, or 18 both. 19 (3) One at-large representative appointed by 20 the President. 21 (d) QUALIFICATIONS.—The members appointed 22 under subsections (c) (2) and (3) shall not be employees 23 of the Federal Government. 24 VerDate Sep 11 2014 22:57 Oct 26, 2020 Jkt 019200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H8446.IH H8446 jbell on DSKJLSW7X2PROD with BILLS 10 •HR 8446 IH (e) TERMS.—The President shall appoint the mem- 1 bers under subsections (c) (2) and (3) for a term of 5 2 years, except that the President shall designate staggered 3 terms for the members initially appointed to the Manage- 4 ment Council. The President may reappoint a member to 5 not more than three consecutive terms. 6 (f) VACANCIES.—Vacancies of members appointed 7 under subsections (c) (2) and (3) shall be filled in the 8 same manner as such positions were originally filled as 9 soon as practicable after the vacancy has occurred. 10 (g) COMPENSATION.—Members appointed under sub- 11 sections (c) (2) and (3) shall serve without pay, except 12 for reasonable travel expenses, including per diem in lieu 13 of subsistence, at the rate authorized for employees of 14 agencies under subchapter I of chapter 57 of title 5, 15 United States Code, while away from their homes or reg- 16 ular places of business in the performance of duties for 17 the Council. 18 (h) CHAIR.—The members shall select the chair of 19 the Management Council from the members appointed 20 under subsection (c) (2) and (3) for a term beginning on 21 the date of selection, and ending in 5 years or until the 22 member’s term of office expires, whichever occurs first. 23 (i) STAFF ASSISTANCE.—The Management Council 24 may request administrative assistance from Federal em- 25 VerDate Sep 11 2014 22:57 Oct 26, 2020 Jkt 019200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\H8446.IH H8446 jbell on DSKJLSW7X2PROD with BILLS 11 •HR 8446 IH ployees under the jurisdiction of the Secretary of the Inte- 1 rior or the Secretary of Agriculture. 2 (j) MEETINGS.— 3 (1) FREQUENCY.—The Management Council 4 shall meet at the call of the Chair or a majority of 5 the members. Meetings shall be held no less than 6 once per year. A majority must be present to con- 7 stitute a quorum to conduct official business. 8 (2) ANNOUNCEMENT; OPEN MEETINGS.—All 9 meetings of the Management Council shall be an- 10 nounced at least one week in advance in publications 11 of general circulation and shall be open to the pub- 12 lic. 13 (k) ADMINISTRATION.— 14 (1) The Management Council shall allow hunt- 15 ing, fishing and trapping on lands and water under 16 the jurisdiction of the Secretary within the 17 Escalante Canyons National Park and Preserve in 18 accordance with the applicable laws of the State of 19 Utah. 20 (2) The Management Council shall ensure that 21 the privilege of grazing domestic livestock on lands 22 with the Escalante Canyons National Park and Pre- 23 serve shall continue to be exercised and enhanced in 24 perpetuity.
