Mr. BOOKER) introduced the following bill; which was read twice and re-
ferred to the Committee on the Judiciary
A BILL
To prohibit Federal law enforcement officers from wearing
camouflage uniforms in the United States.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. PROHIBITION ON FEDERAL LAW ENFORCE-
3
MENT OFFICERS FROM WEARING CAMOU-
4
FLAGE UNIFORMS IN THE UNITED STATES.
5
(a) DEFINITIONS.—In this section—
6
(1) the term ‘‘covered Federal law enforcement
7
officer’’—
8
(A) means—

(i) an officer, employee, or agent in a
1
position in the executive, legislative, or ju-
2
dicial branch of the Federal Government
3
who is authorized by law to engage in or
4
supervise a law enforcement function; or
5
(ii) an employee or officer of a con-
6
tractor or subcontractor (at any tier) of an
7
agency in the executive, legislative, or judi-
8
cial branch of the Federal Government who
9
is authorized by law or under the contract
10
with the agency to engage in or supervise
11
a law enforcement function; and
12
(B) does not include—
13
(i) an officer, employee, agent, or
14
member of the Coast Guard;
15
(ii) a member of an Armed Force; or
16
(iii) a military police officer;
17
(2) the term ‘‘law enforcement function’’ means
18
the prevention, detection, or investigation of any vio-
19
lation of law;
20
(3) the term ‘‘member of an Armed Force’’
21
means a member of any of the armed forces, as de-
22
fined in section 101(a)(4) of title 10, United States
23
Code, or a member of the National Guard, as de-

fined in section 101(3) of title 32, United States
1
Code; and
2
(4) the term ‘‘United States’’, as used in a ter-
3
ritorial sense, includes all places and waters, conti-
4
nental or insular, subject to the jurisdiction of the
5
United States.

(b) PROHIBITION.—
7
(1) IN GENERAL.—Except as provided in para-
8
graph (2), a covered Federal law enforcement officer
9
may not wear a uniform that includes a camouflage
10
pattern in the United States.
11
(2) EXCEPTION.—Paragraph (1) shall not
12
apply to the wearing of a uniform that includes a
13
camouflage pattern that matches the surrounding
14
environment during a period during which a covered
15
Federal law enforcement officer is engaged in a dis-
16
creet tactical operation where the ability to blend
17
into the surroundings is judged to be necessary for
18
the success of the operation.
19
(c) REPORTING.—Each agency that employees or
20
contracts for the services of one or more covered Federal
21
law enforcement officers shall submit to Congress a bian-
22
nual report documenting any wearing of a uniform that
23
includes a camouflage pattern by a covered Federal law
24
enforcement officer of the agency under the exception

under subsection (b)(2) during the period covered by the

report, which shall include the date, operation, and jus-
2
tification for invoking exception.
