To amend the Servicemembers Civil Relief Act to provide
clarification of delivery of notice of termination of leases
of premises and motor vehicles, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Modernizing Notice
4
of Lease Terminations for Servicemembers Act of 2020’’.

SEC. 2. CLARIFICATION OF DELIVERY OF NOTICE OF TER-

MINATION OF LEASES OF PREMISES AND

MOTOR VEHICLES FOR PURPOSES OF RELIEF

UNDER
SERVICEMEMBERS
CIVIL
RELIEF

ACT.

(a)
IN
GENERAL.—Section
305(c)(2)
of
the
6
Servicemembers Civil Relief Act (50 U.S.C. 3955(c)(2))
7
is amended—
8
(1) in subparagraph (B), by striking ‘‘or’’ at
9
the end;
10
(2) in subparagraph (C), by striking the period
11
and inserting ‘‘; or’’; and
12
(3) by adding at the end the following new sub-
13
paragraph:
14
‘‘(D) by electronic means, including—
15
‘‘(i) the direct delivery of material to
16
an electronic address designated by the les-
17
sor (or the lessor’s grantee) or the lessor’s
18
agent (or the agent’s grantee);
19
‘‘(ii) the posting of material to a
20
website or other internet or electronic-
21
based information repository to which ac-
22
cess has been granted to the lessee, the les-
23
sor (or the lessor’s grantee), or the lessor’s
24
agent (or the agent’s grantee); and

‘‘(iii) other electronic means reason-

ably calculated to ensure actual receipt of
2
the material by the lessor (or the lessor’s
3
grantee) or the lessor’s agent (or the
4
agent’s grantee).’’.

(b) EFFECTIVE DATE.—The amendments made by
6
subsection (a) shall apply to delivery of notice of lease ter-
7
minations on or after the date the enactment of this Act.
