Global War on Terrorism Memorial Location Act

IN THE SENATE OF THE UNITED STATES SEPTEMBER 10, 2020 Ms. ERNST (for herself and Ms. HASSAN) introduced the following bill; which was read twice and referred to the Committee on Energy and Natural Resources A BILL To authorize the location of a memorial on the National Mall to commemorate and honor the members of the Armed Forces that served on active duty in support of the Global War on Terrorism, and for other purposes. Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Global War on Ter- 4 rorism Memorial Location Act’’. 5 SEC. 2. NATIONAL GLOBAL WAR ON TERRORISM MEMO- 6 RIAL. 7 (a) FINDINGS.—Congress finds that— 8 VerDate Sep 11 2014 18:13 Sep 11, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S4564.IS S4564 pamtmann on DSKBC07HB2PROD with BILLS 2 •S 4564 IS (1) approaching 2 decades after the September 1 11, 2001, attacks against the United States, the 2 United States continues the Global War on Ter- 3 rorism, at great personal cost to— 4 (A) the men and women serving on active 5 duty in the Armed Forces; and 6 (B) the individuals on whose support those 7 men and women depend to fulfill their duties; 8 (2) civil servants from Federal departments and 9 agencies, the intelligence community, local emer- 10 gency responders, and other civilian support per- 11 sonnel have made significant sacrifices in service in 12 the Global War on Terrorism; 13 (3) honoring the losses endured by the individ- 14 uals described in paragraphs (1) and (2), together 15 with their families, Congress in 2017 unanimously 16 passed, and the President signed, the Global War on 17 Terrorism War Memorial Act (Public Law 115–51; 18 40 U.S.C. 8903 note), which allowed the Global War 19 on Terrorism Memorial Foundation to establish on 20 Federal land in the District of Columbia a memorial 21 to the fallen of that conflict; and 22 (4) given the significance of the Global War on 23 Terrorism as the longest-running conflict in United 24 States history and the magnitude of the sacrifice in- 25 VerDate Sep 11 2014 18:13 Sep 11, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S4564.IS S4564 pamtmann on DSKBC07HB2PROD with BILLS 3 •S 4564 IS volved in operations in that conflict, it is appropriate 1 to locate the National Global War on Terrorism Me- 2 morial within the Reserve alongside existing memo- 3 rials to the major armed conflicts of the United 4 States. 5 (b) DEFINITIONS.—In this section: 6 (1) MEMORIAL.—The term ‘‘Memorial’’ means 7 the National Global War on Terrorism Memorial au- 8 thorized by subsection (c)(1). 9 (2) RESERVE.—The term ‘‘Reserve’’ has the 10 meaning given the term in section 8902(a) of title 11 40, United States Code. 12 (c) LOCATION OF MEMORIAL.— 13 (1) AUTHORIZATION.—Notwithstanding section 14 8908(c) of title 40, United States Code, the Global 15 War on Terrorism Memorial Foundation may estab- 16 lish the National Global War on Terrorism Memorial 17 within the Reserve. 18 (2) LOCATION.—The Memorial shall be located 19 at 1 of the following sites, as identified in, and in 20 accordance with, the document commonly known as 21 the ‘‘Memorials and Museums Master Plan’’: 22 (A) Potential Site 1—Constitution Gar- 23 dens, Prime Candidate Site 10 in The Memo- 24 rials and Museums Master Plan. 25 VerDate Sep 11 2014 18:13 Sep 11, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S4564.IS S4564 pamtmann on DSKBC07HB2PROD with BILLS 4 •S 4564 IS (B) Potential Site 2—JFK Hockey Fields, 1 Prime Candidate Site 18 in The Memorials and 2 Museums Master Plan. 3 (C) Potential Site 3—West Potomac Park, 4 Candidate Site 70 in The Memorials and Muse- 5 ums Master Plan. 6 (3) COMMEMORATIVE WORKS ACT.—Except as 7 otherwise provided in paragraphs (1) and (2), chap- 8 ter 89 of title 40, United States Code (commonly 9 known as the ‘‘Commemorative Works Act’’), shall 10 apply to the Memorial. 11 Æ VerDate Sep 11 2014 18:13 Sep 11, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S4564.IS S4564 pamtmann on DSKBC07HB2PROD with BILLS
