Drug-Impaired Driving Education Act of 2020

Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Drug-Impaired Driving 4 Education Act of 2020’’. 5 SEC. 2. DRUG-IMPAIRED DRIVING EDUCATION GRANT PRO- 6 GRAM. 7 (a) ESTABLISHMENT.—Not later than 1 year after 8 the date of enactment of this Act, the Secretary of Trans- 9 VerDate Sep 11 2014 22:20 Sep 04, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H8129.IH H8129 pbinns on DSKJLVW7X2PROD with BILLS 2 •HR 8129 IH portation shall establish a program to provide grants on 1 a competitive basis to States to educate the public on the 2 dangers of drug-impaired driving. 3 (b) APPLICATION FOR GRANT.—To be eligible for a 4 grant provided under this Act, a State shall submit to the 5 Secretary an application in such form, at such time, and 6 containing such information as the Secretary may require. 7 (c) USE OF GRANT THROUGH COVERED ENTITY.— 8 A State that receives a grant under the program estab- 9 lished under subsection (a) may use such grant to provide 10 funds to a covered entity that will educate the public on 11 the dangers of drug-impaired driving. 12 (d) BEST AVAILABLE EVIDENCE.—A State that re- 13 ceives a grant provided under this Act, or an entity using 14 funds provided by a State that received such grant, to edu- 15 cate the public on the dangers of drug-impaired driving 16 shall— 17 (1) use evidence and strategies recommended by 18 the Congressional Research Service publication titled 19 ‘‘Marijuana Use and Highway Safety’’, published in 20 May, 2019; 21 (2) use evidence and strategies recommended by 22 the National Highway Traffic Safety Administration 23 publication titled ‘‘Countermeasures That Work: A 24 Highway Safety Countermeasure Guide For State 25 VerDate Sep 11 2014 22:20 Sep 04, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H8129.IH H8129 pbinns on DSKJLVW7X2PROD with BILLS 3 •HR 8129 IH Highway Safety Offices, Ninth Edition, 2017’’, pub- 1 lished in April, 2018; or 2 (3) use other evidence-based, peer-reviewed 3 strategies as determined by the Secretary. 4 (e) AUTHORIZATION OF APPROPRIATIONS.—There is 5 authorized to be appropriated to carry out this Act 6 $5,000,000 for each of the first 2 fiscal years beginning 7 after the date of enactment of this Act. 8 (f) DEFINITIONS.—In this Act: 9 (1) COVERED ENTITY.—The term ‘‘covered en- 10 tity’’ includes the following: 11 (A) A State government agency. 12 (B) A local government agency or political 13 subdivision of a State. 14 (C) An Indian Tribal Government. 15 (D) A nonprofit organization. 16 (E) A State or local prosecution office. 17 (F) A State or local law enforcement agen- 18 cy. 19 (2) DRUG-IMPAIRED DRIVING.—The term 20 ‘‘drug-impaired driving’’ means driving under the in- 21 fluence of marijuana, opioids, or other substances, 22 which may impair driving, as determined by the Sec- 23 retary. 24 VerDate Sep 11 2014 22:20 Sep 04, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H8129.IH H8129 pbinns on DSKJLVW7X2PROD with BILLS 4 •HR 8129 IH (3) MARIJUANA.—The term ‘‘marijuana’’ has 1 the meaning given such term in section 4008 of the 2 FAST Act (Public Law 114–94). 3 (4) NONPROFIT ORGANIZATION.—The term 4 ‘‘nonprofit organization’’ means an organization that 5 is described in section 501(c)(3) of the Internal Rev- 6 enue Code of 1986 (26 U.S.C. 501(c)(3)) and is ex- 7 empt from taxation under section 501(a) of such 8 Code. 9 (5) SECRETARY.—The term ‘‘Secretary’’ means 10 the Secretary of Transportation. 11 (6) STATE.—The term ‘‘State’’ means a State 12 of the United States, the District of Columbia, each 13 territory of the United States, and each federally 14 recognized Indian Tribe. 15 Æ VerDate Sep 11 2014 22:20 Sep 04, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H8129.IH H8129 pbinns on DSKJLVW7X2PROD with BILLS
