A BILL
To amend the Help America Vote Act of 2002 to direct
the Election Assistance Commission to make payments
under such Act to States for the services of cyber naviga-
tors to provide election officials with access to risk man-
agement, resiliency, and technical support services in the
administration of elections for Federal office.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Cyber Navigators for
4
Elections Act’’.

SEC. 2. PAYMENTS BY ELECTION ASSISTANCE COMMISSION

TO STATES FOR SERVICES OF CYBER NAVIGA-

TORS.

(a) AVAILABILITY OF GRANTS.—Subtitle D of title
4
II of the Help America Vote Act of 2002 (52 U.S.C.
5
21001 et seq.) is amended by adding at the end the fol-
6
lowing new part:

‘‘PART 7—PAYMENTS FOR OBTAINING SERVICES
8
OF CYBER NAVIGATORS
9
‘‘SEC. 297. PAYMENTS FOR OBTAINING SERVICES OF CYBER
10
NAVIGATORS.
11
‘‘(a) AVAILABILITY AND USE OF PAYMENTS.—The
12
Commission shall make a payment to each eligible State
13
to obtain services of cyber navigators who will provide elec-
14
tion officials of the jurisdictions of the State which admin-
15
ister elections for Federal office with access to risk man-
16
agement, resiliency, and technical support services in the
17
administration of such elections.

‘‘(b) SCHEDULE OF PAYMENTS.—As soon as prac-
19
ticable after the date of the enactment of this part (but
20
in no event later than 6 months thereafter), and not less
21
frequently than once each calendar year thereafter, the
22
Commission shall make payments under this part.

‘‘SEC. 297A. AMOUNT OF PAYMENT.
24
‘‘(a) IN GENERAL.—The amount of a payment made
25
to an eligible State or an eligible unit of local government

for a year under this part shall be determined by the Com-

mission.

‘‘(b) CONTINUING AVAILABILITY OF FUNDS AFTER
3
APPROPRIATION.—A payment made to an eligible State
4
or eligible unit of local government under this part shall
5
be available without fiscal year limitation.
6
‘‘SEC. 297B. REQUIREMENTS FOR ELIGIBILITY.
7
‘‘(a) APPLICATION.—Each State that desires to re-
8
ceive a payment under this part for a fiscal year shall sub-
9
mit an application for the payment to the Commission at
10
such time and in such manner and containing such infor-
11
mation as the Commission shall require.
12
‘‘(b) CONTENTS OF APPLICATION.—Each application
13
submitted under subsection (a) shall—
14
‘‘(1) describe the activities for which assistance
15
under this part is sought; and
16
‘‘(2) provide such additional information and
17
certifications as the Commission determines to be es-
18
sential to ensure compliance with the requirements
19
of this part.

‘‘SEC. 297C. AUTHORIZATION OF APPROPRIATIONS.
21
‘‘There are authorized to be appropriated for grants
22
under this part $50,000,000 for each of the fiscal years
23
2020 through 2024.

‘‘SEC. 297D. REPORTS.

‘‘(a) REPORTS BY RECIPIENTS.—Not later than the
2
6 months after the end of each fiscal year for which an
3
eligible State received a payment under this part, the
4
State shall submit a report to the Commission on the ac-
5
tivities conducted with the funds provided during the year.
6
‘‘(b) REPORTS BY COMMISSION TO COMMITTEES.—
7
With respect to each fiscal year for which the Commission
8
makes payments under this part, the Commission shall
9
submit a report on the activities carried out under this
10
part to the Committee on House Administration of the
11
House of Representatives and the Committee on Rules
12
and Administration of the Senate.’’.

(b) CLERICAL AMENDMENT.—The table of contents
14
of such Act is amended by adding at the end of the items
15
relating to subtitle D of title II the following:

‘‘PART 7—PAYMENTS FOR OBTAINING SERVICES OF CYBER NAVIGATORS
