Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. EXTENSION OF PHYSICAL PRESENCE WAIVER 1 UNDER WIC DURING CERTAIN PUBLIC 2 HEALTH EMERGENCIES. 3 Section 2203 of the Families First Coronavirus Re- 4 sponse Act (Public Law 116–127; 42 U.S.C. 1786 note) 5 is amended— 6 (1) in subsection (a)(2), by striking ‘‘any por- 7 tion’’ and all that follows through the period at the 8 end and inserting ‘‘the qualified emergency period 9 described in subsection (c)(1).’’; and 10 (2) by amending subsection (c) to read as fol- 11 lows: 12 ‘‘(c) APPLICABILITY.— 13 ‘‘(1) QUALIFIED EMERGENCY PERIOD.—The 14 qualified emergency period described in this para- 15 graph is the period— 16 ‘‘(A) beginning on March 18, 2020; and 17 ‘‘(B) ending on September 30, 2021. 18 ‘‘(2) EFFECT OF EXTENSION.—The Secretary 19 may extend (without further application) a waiver 20 approved by the Secretary and received by a State 21 agency under this section before the date of the en- 22 actment of the WIC Waiver Extension Act of 2020 23 such that such waiver applies during the qualified 24 emergency period described in paragraph (1). 25 VerDate Sep 11 2014 23:10 Aug 29, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H8024.IH H8024 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 8024 IH ‘‘(3) SUNSET.—The authority under this sec- 1 tion shall expire on September 30, 2021.’’. 2 SEC. 3.
