DEFINITION OF ADMINISTRATOR. 1 In this Act, the term ‘‘Administrator’’ means the Ad- 2 ministrator of the Environmental Protection Agency. 3 SEC. 3. LIFECYCLE GREENHOUSE GAS EMISSIONS FROM 4 CORN-BASED ETHANOL. 5 (a) IN GENERAL.—Subject to subsection (b), not 6 later than 90 days after the date of enactment of this Act, 7 and every 5 years thereafter, the Administrator shall up- 8 date the methodology used by the Environmental Protec- 9 tion Agency in lifecycle analyses with respect to green- 10 house gas emissions that result from corn-based ethanol. 11 (b) REQUIREMENTS.— 12 (1) FIRST UPDATE.—In carrying out the first 13 update required under subsection (a), the Adminis- 14 trator shall adopt— 15 (A) the most recent Greenhouse gases, 16 Regulated Emissions, and Energy use in Trans- 17 portation model (commonly referred to as the 18 ‘‘GREET model’’) developed by Argonne Na- 19 tional Laboratory; or 20 (B) the methodology described in the study 21 by the Office of the Chief Economist of the De- 22 partment of Agriculture entitled ‘‘The green- 23 house gas benefits of corn ethanol–assessing re- 24 cent evidence’’ and published on March 25, 25 2019. 26 VerDate Sep 11 2014 18:28 Aug 25, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S4481.IS S4481 pamtmann on DSKBC07HB2PROD with BILLS 3 •S 4481 IS (2) SUBSEQUENT UPDATES.—In carrying out 1 the second and each subsequent update required 2 under subsection (a), the Administrator shall— 3 (A) as necessary, adopt, review, or update 4 a methodology determined to be appropriate by 5 the Administrator; or 6 (B) adopt a methodology described in sub- 7 paragraph (A) or (B) of paragraph (1). 8 (c) REPORT.—If the Administrator fails to carry out 9 subsection (b)(2) before the applicable deadline described 10 in subsection (a), the Administrator shall submit to the 11 Committees on Agriculture, Nutrition, and Forestry, En- 12 ergy and Natural Resources, and Environment and Public 13 Works of the Senate and the Committees on Agriculture, 14 Energy and Commerce, and Science, Space, and Tech- 15 nology of the House of Representatives a report describing 16 the reasons for the failure to carry out subsection (b)(2), 17 which may include a determination by the Administrator 18 that the methodology adopted or updated in a previous 19 update under subsection (a) remains the most current 20 methodology based on available data, research, and tech- 21 nology. 22 VerDate Sep 11 2014 18:28 Aug 25, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S4481.IS S4481 pamtmann on DSKBC07HB2PROD with BILLS 4 •S 4481 IS SEC. 4.
