A BILL
To direct the Secretary of Health and Human Services to
award grants to eligible entities to establish, improve,
and maintain mobile testing programs for SARS–CoV–
2 and COVID–19, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Mobile Options for
4
Testing In Our Neighborhoods Act’’ or the ‘‘MOTION
5
Act’’.

SEC. 2. MOBILE TESTING FOR SARS–COV–2 AND COVID–19.

(a) IN GENERAL.—Not later than 120 days after the
2
date of the enactment of this Act, the Secretary of Health
3
and Human Services (in this Act referred to as the ‘‘Sec-
4
retary’’) shall award grants to establish, improve, and
5
maintain mobile testing programs to conduct testing for
6
SARS–CoV–2 and COVID–19.
7
(b) ELIGIBLE ENTITY.—In this section, the term ‘‘el-
8
igible entity’’ means—
9
(1) a health center (as defined in section 330
10
of the Public Health Service Act (42 U.S.C. 3
11
254b)), including community health centers;
12
(2) a federally qualified health center (as de-
13
fined in section 1861 of the Social Security Act (42
14
U.S.C. 1395x));
15
(3) a rural health clinic (as defined in section
16
1861 of the Social Security Act (42 U.S.C. 1395x));
17
(4) a State, local, Tribal, or territorial health
18
department;
19
(5) medical centers and research labs at an in-
20
stitution of higher education (as defined in section
21
101 of the Higher Education Act of 1965 (20
22
U.S.C. 1001));
23
(6) nonprofit organizations; and
24
(7) any other entity as determined by the Sec-
25
retary.

(c) USE
OF FUNDS.—An eligible entity receiving
1
grant funds under subsection (a) shall use the funds to—
2
(1) purchase equipment and supplies to conduct
3
mobile testing for SARS–CoV–2 and COVID–19;
4
(2) serve multiple communities (including zip
5
codes or cities) in a period determined by the Sec-
6
retary;
7
(3) purchase, lease, and maintain mobile vehi-
8
cles and equipment to conduct such testing;
9
(4) hire and train laboratory personnel and
10
other staff to conduct such testing;
11
(5) provide or administer, as the case may be—
12
(A) vaccines licensed under section 351 of
13
the Public Health Service Act (42 U.S.C. 262)
14
for SARS–CoV–2 or COVID–19; and
15
(B) drugs and biological products—
16
(i) approved under sections 505 and
17
564 of the Federal Food, Drug, and Cos-
18
metic Act (21 U.S.C. 355 and 360bbb–3)
19
for SARS–CoV–2 or COVID–19; or
20
(ii) licensed under section 351 of the
21
Public Health Service Act (42 U.S.C. 262)
22
for the cure, mitigation, or treatment of
23
SARS–CoV–2 or COVID–19; and

(6) carry out other activities related to such
1
testing, as determined by the Secretary.

(d) CONSIDERATION.—In establishing the grant pro-
3
gram under subsection (a), the Secretary shall take into
4
consideration COVID–19 testing plans required under the
5
fourth proviso under the second paragraph under the
6
heading ‘‘Department of Health and Human Services—
7
Office of the Secretary—Public Health and Social Serv-
8
ices’’ of title 1 of division B of the Paycheck Protection
9
Program and Health Care Enhancement Act (Public Law
10
116–139).

(e) PRIORITY.—In awarding grants pursuant to this
12
section, the Secretary shall give priority to eligible entities
13
that serve—
14
(1) communities that have limited access to
15
transportation, including communities—
16
(A) with a high percentage of households
17
that do not have access to private vehicles;
18
(B) that do not have public transit;
19
(C) with a high percentage of individuals
20
who primarily use public transit for transpor-
21
tation; or
22
(D) with reduced access to public transit
23
as a result of the spread of COVID–19;

(2) medically underserved populations (as de-
1
fined in section 330(b)(3) of the Public Health Serv-
2
ice Act (42 U.S.C 254b(b)(3))); and
3
(3) health professional shortage areas (as de-
4
fined in section 330(a) of the Public Health Service
5
Act (42 U.S.C 254e(a))).

(f) REPORTS.—
7
(1) REPORT TO SECRETARY.—Not later than 1
8
year after the date of the enactment of this Act, an
9
entity that receives grant funds pursuant to this Act
10
shall submit to the Secretary a report on the activi-
11
ties carried out using such grant funds.
12
(2) REPORT TO CONGRESS.—Not later than De-
13
cember 31, 2021, the Secretary shall submit to Con-
14
gress a report on the effectiveness of the activities
15
carried out pursuant to this Act.
16
(g) AUTHORIZATION OF APPROPRIATIONS.—There is
17
authorized to be appropriated to carry out this Act
18
$400,000,000, to remain available until expended.
