AN ACT
To amend the Nutria Eradication and Control Act of 2003
to include California in the program, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. NUTRIA ERADICATION.

The Nutria Eradication and Control Act of 2003
2
(Public Law 108–16) is amended—
3
(1) in section 2—
4
(A) in subsection (a)—
5
(i) in paragraph (1), by striking
6
‘‘Wetlands and tidal marshes of the Chesa-
7
peake Bay and in Louisiana’’ and inserting
8
‘‘Wetlands, tidal marshes, and agricultural
9
lands’’;
10
(ii) in paragraph (2), by striking ‘‘in
11
Maryland and Louisiana’’; and
12
(iii) by amending paragraph (3) to
13
read as follows:

‘‘(3) Traditional harvest methods to control or
15
eradicate nutria have failed. Consequently, marsh
16
loss, loss of public and private wetlands, and loss of
17
agricultural lands are accelerating.’’; and
18
(B) in subsection (b), by striking ‘‘the
19
State of Maryland and the State of Louisiana’’
20
and inserting ‘‘any State that has demonstrated
21
the need’’; and
22
(2) in section 3—
23
(A) by amending subsection (a) to read as
24
follows:

‘‘(a) GRANT AUTHORITY.—The Secretary of the Inte-

rior (referred to in this Act as the ‘Secretary’), may pro-
2
vide financial assistance to a State, in an amount that is
3
in proportion to the total impacted area of such State af-
4
fected by nutria, that has demonstrated to the Secretary
5
sufficient need for a program to implement measures to
6
eradicate or control nutria and restore marshland, public
7
and private wetlands, and agricultural lands damaged by
8
nutria.’’;

(B) by striking subsection (b);
10
(C) in subsection (d)—
11
(i) in paragraph (1), by striking ‘‘the
12
program may’’ and inserting ‘‘a State pro-
13
gram referred to in subsection (a) may’’;
14
and
15
(ii) in paragraph (2), by striking ‘‘the
16
program may’’ and inserting ‘‘a State pro-
17
gram referred to in subsection (a) may’’;
18
(D) in subsection (e), by inserting ‘‘to a
19
State’’ after ‘‘provided’’;

(E)
in
subsection
(f),
by
striking
21
‘‘$4,000,000’’ and all that follows and inserting
22
‘‘$12,000,000 for each of fiscal years 2021
23
through 2025.’’; and
