Ms. CORTEZ MASTO introduced the following bill; which was read twice and
referred to the Committee on Agriculture, Nutrition, and Forestry
A BILL
To amend the Families First Coronavirus Response Act to
temporarily modify child nutrition programs due to
COVID–19, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Child Nutrition Relief
4
Act of 2020’’.
5
SEC. 2. WAIVERS FOR SCHOOLS DUE TO COVID–19.
6
(a) SCHOOL CLOSURES.—Section 2102(d) of the
7
Families First Coronavirus Response Act (42 U.S.C. 1760
8
note; Public Law 116–127) is amended—

(1) in paragraph (1), by striking ‘‘and’’ at the
1
end;
2
(2) in paragraph (2), by striking ‘‘providing
3
meals and meal supplements under such Acts during
4
a school closure due to COVID-19.’’ and inserting
5
‘‘providing, during a school closure (including full or
6
partial building closure) due to COVID–19, meals
7
and meal supplements under such Acts through
8
modified meal service models that achieve social
9
distancing; and’’; and
10
(3) by adding at the end the following:
11
‘‘(3) that shall not terminate prior to August
12
31, 2021.’’.

(b) NATIONAL SCHOOL LUNCH PROGRAM REQUIRE-
14
MENTS.—Section 2202 of the Families First Coronavirus
15
Response Act (42 U.S.C. 1760 note; Public Law 116–127)
16
is amended—
17
(1) in subsection (c)—
18
(A) by redesignating paragraphs (1) and
19
(2) as subparagraphs (A) and (B), respectively,
20
and indenting appropriately;
21
(B) in the matter preceding subparagraph
22
(A) (as so redesignated), by striking ‘‘Notwith-
23
standing’’ and inserting the following:
24
‘‘(1) IN GENERAL.—Notwithstanding’’; and

(C) by adding at the end the following:

‘‘(2) GUIDANCE.—The Secretary shall provide
2
guidance on serving hot meals under a waiver grant-
3
ed under this subsection.’’; and
4
(2) by striking subsection (e) and inserting the
5
following:
6
‘‘(e) SUNSET.—The authority of the Secretary to es-
7
tablish or grant a waiver under this section shall expire
8
on—
9
‘‘(1) June 30, 2021, with respect to a waiver
10
under a qualified program described in subpara-
11
graphs (A) through (C) of subsection (f)(1); and
12
‘‘(2) August 31, 2021, with respect to a waiver
13
under the qualified program described in subpara-
14
graph (D) of that subsection.’’.
