Mr. WARNER (for himself, Ms. SMITH, Mr. BLUMENTHAL, Ms. HARRIS, Mr.

RICH, and Mr. COONS) introduced the following bill; which was read twice
and referred to the Committee on Finance
A BILL
To amend subtitle A of title II of division A of the CARES
Act to provide Pandemic Unemployment Assistance to
individuals with mixed income sources, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Mixed Earner Pan-
4
demic Unemployment Assistance Act of 2020’’.

SEC. 2. COVERAGE OF MIXED-INCOME INDIVIDUALS.

(a) IN GENERAL.—Section 2102(c) of the CARES
2
Act (Public Law 116–136) is amended by adding at the
3
end the following:
4
‘‘(4) COVERAGE
OF
MIXED-INCOME
INDIVID-
5
UALS.—In the case of an individual who—
6
‘‘(A)(i) would be a covered individual but
7
for subsection (a)(3)(A)(i); or
8
‘‘(ii) is employed but is unable or unavail-
9
able to earn self-employment income because of
10
factors described in subsection (a)(3)(A)(ii) and
11
otherwise satisfies the requirements of sub-
12
section (a)(3);
13
‘‘(B) during the individual’s most recent
14
taxable year ending prior to the individual’s ap-
15
plication for assistance under this section, re-
16
ceived at least $7,250 from self-employment;
17
and
18
‘‘(C) makes an irrevocable election to be
19
treated as a covered individual under this sec-
20
tion for each week, with respect to which assist-
21
ance under this section is available, that be-
22
gins—
23
‘‘(i) after the date of such election; or
24
‘‘(ii) before such date, but only if the
25
individual did not otherwise receive unem-

ployment benefits for such week under this
1
section, section 2104, section 2107, or as
2
determined under State law,
3
such individual shall be treated as a covered indi-
4
vidual described in subsection (d)(2) for such weeks.
5
An individual with respect to which this paragraph
6
applies for a week shall be deemed ineligible for reg-
7
ular compensation or extended benefits under State
8
or Federal law or pandemic emergency unemploy-
9
ment compensation under section 2107 for such
10
week.’’.

(b) APPLICABILITY.—The amendment made by sub-
12
section (a) shall not apply with respect to a State partici-
13
pating in an agreement under section 2102 of the CARES
14
Act (Public Law 116–136) unless the State so elects, and
15
shall become effective as determined by such State in
16
agreement with the Secretary of Labor.
