Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. REQUIREMENTS FOR PROVISION OF ANTIVIRUS 1 SOFTWARE TO CERTAIN INDIVIDUALS AF- 2 FECTED BY DATA BREACH. 3 (a) REQUIREMENT TO PROCURE ANTIVIRUS PROD- 4 UCT.— 5 (1) IN GENERAL.—The Administrator for Gen- 6 eral Services shall procure an antivirus product suit- 7 able for Federal agencies to provide to individuals 8 whose personally identifiable information may have 9 been compromised. 10 (2) DEADLINE.—As soon as practicable after 11 the date of the enactment of this Act, the Adminis- 12 trator shall issue a solicitation for vendors to provide 13 the antivirus product described in paragraph (1). 14 Not later than 1 year after such date, the Adminis- 15 trator shall award the contract for the product. 16 (b) REQUIREMENT TO PROVIDE ONE-YEAR LICENSE 17 FOR USE OF ANTIVIRUS PRODUCT.—A Federal agency 18 that experiences a compromise in its computer systems re- 19 sulting in the loss of personally identifiable information 20 shall provide to any individual directly affected a one-year 21 license of the antivirus product procured under subsection 22 (a). 23 (c) FEDERAL AGENCY.—In this section, the term 24 ‘‘Federal agency’’ has the meaning provided the term ‘‘Ex- 25 ecutive agency’’ in section 105 of title 5, United States 26 VerDate Sep 11 2014 04:13 Aug 18, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H7901.IH H7901 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 7901 IH Code, and also includes the United States Postal Service 1 and the Postal Regulatory Commission. 2 (d) SOURCE OF FUNDS.—The funds used by a Fed- 3 eral agency to carry out this Act shall be derived from 4 amounts made available to the agency for operating ex- 5 penses. 6 Æ VerDate Sep 11 2014 04:13 Aug 18, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H7901.IH H7901 kjohnson on DSK79L0C42PROD with BILLS
