A BILL
To amend the CARES Act to clarify authorized uses of
provider relief funds, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Remote Patient Moni-
4
toring Access Act’’ or ‘‘RPM Access Act’’.
5
SEC. 2. CLARIFICATION OF AUTHORIZED USES OF PRO-
6
VIDER RELIEF FUNDS.

(a) CLARIFICATION.—Title VIII of division B of the
8
Coronavirus Aid, Relief, and Economic Security Act (Pub-
9
lic Law 116–136) is amended in the third paragraph

under the heading ‘‘Office of the Secretary—Public

Health and Social Services Emergency Fund’’ by inserting
2
after the fifth proviso the following: ‘‘Provided further,
3
That funds appropriated under this paragraph in this Act
4
shall be available for the costs associated with furnishing
5
remote patient monitoring services that meet evidence-
6
based practice guidelines or clinical practice guidelines (in-
7
cluding but not limited to such guidelines issued by profes-
8
sional medical associations, voluntary health organiza-
9
tions, or agencies of the Department of Health and
10
Human Services (including the National Institutes of
11
Health)) and that meet appropriate patient data security
12
and privacy standards (including but not limited to such
13
standards established under the Health Insurance Port-
14
ability and Accountability Act of 1996, the National Insti-
15
tute of Standards and Technology Common Security
16
Framework, or the international standard for information
17
security management system ISO/IEC 27001):’’.

(b) EFFECTIVE DATE.—The amendment made by
19
subsection (a) shall take effect as if included in the enact-
20
ment of the Coronavirus Aid, Relief, and Economic Secu-
21
rity Act (Public Law 116–136).
