To amend title 38, United States Code, to make modifications to the edu-
cational assistance programs of the Department of Veterans Affairs
relating to apprenticeship and on-job training for participants who be-
come unemployed, and for other purposes.

A BILL
To amend title 38, United States Code, to make modifica-
tions to the educational assistance programs of the De-
partment of Veterans Affairs relating to apprenticeship
and on-job training for participants who become unem-
ployed, and for other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. MODIFICATIONS TO VETERANS EDUCATIONAL

ASSISTANCE RELATING TO APPRENTICESHIP
2
OR ON-JOB TRAINING REQUIREMENTS AND
3
UNEMPLOYMENT.

(a) IN GENERAL.—Paragraph (2) of subsection (e)
5
of section 3687 of title 38, United States Code, is amend-
6
ed to read as follows:
7
‘‘(2)(A) Subject to subparagraphs (B) and (C),
8
for any month in which an individual fails to com-
9
plete 120 hours of training, the entitlement other-
10
wise chargeable under paragraph (1) shall be re-
11
duced in the same proportion as the monthly train-
12
ing assistance allowance payable is reduced under
13
subsection (b)(3).
14
‘‘(B) In the case of an individual who is unem-
15
ployed, the requirement under subparagraph (A)
16
shall not apply during the shorter of the following
17
periods:
18
‘‘(i) The period the individual is unem-
19
ployed.
20
‘‘(ii) The 120-day period beginning on the
21
date on which the individual becomes unem-
22
ployed.
23
‘‘(C) Any period during which subparagraph
24
(A) does not apply by reason of subparagraph (B)
25
shall not—

‘‘(i) be counted for purposes of section
1
3695 of this title; or
2
‘‘(ii) result in a reduction in the amount of
3
monthly training assistance payable to the indi-
4
vidual pursuant to subsection (b)(3).
5
‘‘(D) The period for which, by reason of sub-
6
paragraph (B), educational assistance is not charged
7
against entitlement or counted toward the applicable
8
aggregate period under section 3695 of this title
9
shall not exceed the aggregate of—
10
‘‘(i) the portion of the period of enrollment
11
in the course from which the individual did not
12
receive credit or with respect to which the indi-
13
vidual lost training time, as determined under
14
subsection (b)(2); and
15
‘‘(ii) the period by which a monthly stipend
16
is extended under section 3680(a)(2)(B) of this
17
title.

‘‘(E)(i) In the case of an individual who fails to
19
complete 120 hours of training during a month, but
20
who completed more than 120 hours of training dur-
21
ing a previous month, the individual may apply the
22
number of hours in excess of 120 that the individual
23
completed for that month to the month for which
24
the individual failed to complete 120 hours.

‘‘(ii) If the addition of such excess hours results
1
in a total of 120 hours or more, the individual shall
2
be treated as an individual who has completed 120
3
hours of training for that month.
4
‘‘(iii) Any excess hours applied to a different
5
month under this subparagraph may only be applied
6
to one such month.’’.
7
(b) APPLICABILITY.—The amendment made by sub-
8
section (a) shall apply to any period beginning on or after
9
March 1, 2020.
