To provide Capitol-flown flags to the immediate family of
frontline workers who died as a result of their service
in response to the COVID–19 pandemic.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Fallen Pandemic He-
4
roes Flag Act of 2020’’.
5
SEC. 2. DEFINITIONS.
6
(a) DEFINITION OF FRONTLINE WORKER.—In this
7
Act, the term ‘‘frontline worker’’ means a person whose
8
occupation presents an increased risk of exposure to
9
COVID-19 and who is one of the following:

(1) Agriculture worker.

(2) Childcare worker.
2
(3) Cleaning service worker.
3
(4) Communication worker.
4
(5) Delivery service worker.
5
(6) First responder.
6
(7) Food service worker.
7
(8) Health care worker.
8
(9) Transportation worker.
9
(10) Other worker as determined by the Archi-

tect of the Capitol through regulations issued under
11
section 4(a)(1).

(b) OTHER DEFINITIONS.—In this Act—
13
(1) the term ‘‘Capitol-flown flag’’ means a
14
United States flag flown over the United States
15
Capitol in honor of the deceased individual;
16
(2) the term ‘‘immediate family member’’, with
17
respect to an individual, means—
18
(A) the spouse, parent, brother, sister,
19
child of the individual, or a person to whom the
20
individual stands in loco parentis; or
21
(B) any other person related to the indi-
22
vidual by blood or marriage; and
23
(3) the term ‘‘Representative’’ includes a Dele-
24
gate or Resident Commissioner to the Congress.

SEC. 3. PROVIDING CAPITOL-FLOWN FLAGS FOR FAMILIES

OF FRONTLINE WORKERS DYING IN RE-
2
SPONSE TO COVID–19 PANDEMIC.

(a) IN GENERAL.—At the request of the immediate
4
family of a frontline worker who, as a result of being a
5
frontline worker, died in responding to the COVID–19
6
pandemic on or after January 1, 2020, the Representative
7
or Senator of the family may provide the family with a
8
Capitol-flown flag, together with the certificate described
9
in subsection (c).
10
(b) NO COST TO FAMILY.—A flag provided under
11
this section shall be provided at no cost to the family.
12
(c) CERTIFICATE.—The certificate described in this
13
subsection is a certificate which is signed by the Speaker
14
of the House of Representatives and the Representative,
15
or the Speaker pro tempore of the Senate and the Senator,
16
providing the Capitol-flown flag, as applicable, and which
17
contains an expression of sympathy from the House of
18
Representatives or the Senate, as applicable.

SEC. 4. REGULATIONS AND PROCEDURES.
20
(a) IN GENERAL.—Not later than 30 days after the
21
date of the enactment of this Act, the Architect of the
22
Capitol shall issue regulations for carrying out this Act,
23
including the following:
24
(1) Regulations to identify other workers that
25
qualify as frontline workers. In doing so, the Archi-

tect shall take into consideration the ‘‘Advisory

Memorandum on Identification of Essential Critical
2
Infrastructure Workers During Covid-19 Response’’
3
as issued by the Cybersecurity and Infrastructure
4
Security Agency on April 17, 2020.

(2) Regulations to establish procedures (includ-
6
ing any appropriate forms, guidelines, and accom-
7
panying certificates) for requesting a Capitol-flown
8
flag.
9
(b) APPROVAL BY COMMITTEES.—The regulations
10
issued under subsection (a) shall take effect upon approval
11
by the Committee on House Administration of the House
12
of Representatives and the Committee on Rules and Ad-
13
ministration of the Senate.

SEC. 5. AUTHORIZATION OF APPROPRIATIONS.
15
There are authorized to be appropriated for each of
16
the fiscal years 2020 through 2025 such sums as may be
17
necessary to carry out this Act, to be derived from
18
amounts appropriated in each such fiscal year for the op-
19
eration of the Office of the Architect of the Capitol, except
20
that the aggregate amount appropriated to carry out this
21
Act for all such fiscal years may not exceed $40,000.
22
SEC. 6. EFFECTIVE DATE.
23
This Act shall take effect on the date of its enact-
24
ment, except that no flags may be provided under section
