lowing bill; which was referred to the Committee on Education and Labor

To temporarily modify child nutrition programs due to
COVID–19, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Child Nutrition Relief
4
Act of 2020’’.
5
SEC. 2. WAIVERS FOR SCHOOLS DUE TO COVID–19.
6
(a) SCHOOL CLOSURES.—Section 2102(d) of the
7
Families First Coronavirus Response Act (42 U.S.C. 1760
8
note; Public Law 116–127) is amended—

(1) in paragraph (1), by striking ‘‘and’’ at the

end;
2
(2) in paragraph (2)—
3
(A) by striking ‘‘during a school closure’’
4
and inserting ‘‘through modified meal service
5
models to achieve social distancing or during a
6
school closure, including planned full or partial
7
building closures,’’; and
8
(B) by striking the period at the end and
9
inserting ‘‘; and’’; and
10
(3) by adding at the end the following:

‘‘(3) that shall not terminate prior to August
12
31, 2021.’’.

(b) NATIONAL SCHOOL LUNCH PROGRAM REQUIRE-
14
MENTS.—Section 2202 of the Families First Coronavirus
15
Response Act (42 U.S.C. 1760 note; Public Law 116–127)
16
is amended—
17
(1) in subsection (c)—
18
(A) by redesignating paragraphs (1) and
19
(2) as subparagraphs (A) and (B), respectively,
20
and indenting appropriately;
21
(B) in the matter preceding subparagraph
22
(A) (as so redesignated), by striking ‘‘Notwith-
23
standing’’ and inserting the following:
24
‘‘(1) IN GENERAL.—Notwithstanding’’; and

(C) by adding at the end the following:

‘‘(2) GUIDANCE.—The Secretary shall provide
2
guidance on serving hot meals under a waiver grant-
3
ed under this subsection.’’; and
4
(2) by amending subsection (e) to read as fol-
5
lows:
6
‘‘(e) SUNSET.—The authority of the Secretary to—
7
‘‘(1) establish or grant a waiver under this sec-
8
tion with respect to a qualified program described in
9
subparagraph (A) through (C) of subsection (f)(1)
10
shall expire on June 30, 2021; and
11
‘‘(2) establish or grant a waiver under this sec-
12
tion with respect to a qualified program described in
13
subparagraph (D) of subsection (f)(1) shall expire
14
on August 31, 2021.’’.
