A BILL
To provide the Administrator of the Drug-Free Communities
Support Program the authority to waive the Federal
fund limitation for the Drug-Free Communities Support
Program.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Drug-Free Commu-
4
nities Pandemic Relief Act’’.

SEC. 2. WAIVER OF FEDERAL FUND LIMITATION FOR THE

DRUG-FREE COMMUNITIES SUPPORT PRO-
2
GRAM.

(a) IN GENERAL.—Subject to subsection (b), if the
4
Administrator of the Drug-Free Communities Support
5
Program determines that, as a result of the public health
6
emergency declared pursuant to section 319 of the Public
7
Health Service Act (42 U.S.C. 247d) as a result of
8
COVID–19, an eligible coalition is unable to raise the
9
amount of non-Federal funds, including in-kind contribu-
10
tions, agreed to be raised by the coalition for a fiscal year
11
under an agreement entered into with the Administrator
12
pursuant to paragraph (1)(A) or (3)(D) of section 1032(b)
13
of the Anti-Drug Abuse Act of 1988 (21 U.S.C. 1532(b)),
14
the Administrator may, notwithstanding such paragraphs,
15
provide to the eligible coalition the grant or renewal grant,
16
as applicable, for that fiscal year in an amount—
17
(1) with respect to an initial grant or renewal
18
grant described under paragraph (1)(A) of such sec-
19
tion, that exceeds the amount of non-Federal funds
20
raised by the eligible coalition, including in-kind con-
21
tributions, for that fiscal year;
22
(2) with respect to a renewal grant described
23
under paragraph (3)(D)(i) of such section, that ex-
24
ceeds 125 percent of the amount of non-Federal

funds raised by the eligible coalition, including in-

kind contributions, for that fiscal year; and
2
(3) with respect to a renewal grant described
3
under paragraph (3)(D)(ii) of such section, that ex-
4
ceeds 150 percent of the amount of non-Federal
5
funds raised by the eligible coalition, including in-
6
kind contributions, for that fiscal year.

(b) LIMITATIONS.—The Administrator may not pro-
8
vide a grant or renewal grant to an eligible coalition in
9
an amount exceeding the amount of funds initially agreed
10
to be provided by the Administrator under the applicable
11
agreement.
