A BILL
To release the City of Banning, California, from all restric-
tions, conditions, and limitations on the use, encum-
brance, conveyance, and closure of the Banning Munic-
ipal Airport.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Banning Airport Rede-
4
velopment Act’’.

SEC. 2. RELEASE OF RESTRICTIONS, CONDITIONS, AND

LIMITATIONS ON THE USE, ENCUMBRANCE,
2
CONVEYANCE, AND CLOSURE OF THE BAN-
3
NING MUNICIPAL AIRPORT.

(a) IN
GENERAL.—The United States, acting
5
through the Administrator of the Federal Aviation Admin-
6
istration, shall release the City of Banning, California,
7
from all restrictions, conditions, and limitations on the
8
use, encumbrance, conveyance, and closure of the Banning
9
Municipal Airport, as described in the most recent airport
10
layout plan approved by the Federal Aviation Administra-
11
tion, to the extent such restrictions, conditions, and limita-
12
tions are enforceable by the Administrator.

(b) LIMITATION.—The release under subsection (a)
14
shall not be executed before the City of Banning, Cali-
15
fornia, or its designee, transfers to the Department of
16
Transportation of the State of California—
17
(1) the amounts described in subsection (c), to
18
be used for FAA-approved capital improvements
19
within the meaning of airport development (as de-
20
fined in section 47102(3) of title 49, United States
21
Code) at other public use, general aviation airports
22
serving the region; and
23
(2) for no consideration, all airport and avia-
24
tion-related equipment of the Banning Municipal
25
Airport owned by the City of Banning and deter-

mined by the FAA or Department of Transportation

of the State of California to be salvageable for use
2
at other airports.

(c) AMOUNTS DESCRIBED.—The amounts described
4
in this subsection are the following:
5
(1) An amount equal to the fair market value
6
for the highest and best use of the Banning Munic-
7
ipal Airport property determined in good faith by 2
8
independent and qualified real estate appraisers and
9
an independent review appraiser on or after the date
10
of the enactment of this Act.
11
(2) An amount equal to the unamortized por-
12
tion of any Federal development grants other than
13
land paid to the City of Banning for use at the Ban-
14
ning Municipal Airport, which may be paid with, and
15
shall be an allowable use of, airport revenue notwith-
16
standing section 47107 or 47133 of title 49, United
17
States Code.

(3) An amount equal to the airport revenues,
19
along with accrued interest, remaining in the airport
20
account for the Banning Municipal Airport as of the
21
date of the enactment of this Act and otherwise due
22
to or received by the City of Banning after such date
23
of enactment pursuant to sections 47107(b) and
24
47133 of title 49, United States Code.

(d) RULE OF CONSTRUCTION.—Nothing in this sec-
1
tion shall be construed to limit the applicability of—
2
(1) the requirements and processes under sec-
3
tion 46319 of title 49, United States Code;
4
(2) the requirements under the National Envi-
5
ronmental Policy Act of 1969 (42 U.S.C. 4321 et
6
seq.);
7
(3) the requirements and processes under part
8
157 of title 14, Code of Federal Regulations; or
9
(4) the public notice requirements under section
10
47107(h)(2) of title 49, United States Code.
