AN ACT
Making appropriations for the Department of State, foreign
operations, and related programs for the fiscal year end-
ing September 30, 2021, and for other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.
1
This Act may be cited as the ‘‘State, Foreign Oper-
2
ations, Agriculture, Rural Development, Interior, Environ-
3
ment, Military Construction, and Veterans Affairs Appro-
4
priations Act, 2021’’.
5
SEC. 2. REFERENCES TO ACT.
6
Except as expressly provided otherwise, any reference
7
to ‘‘this Act’’ contained in any division of this Act shall
8
be treated as referring only to the provisions of that divi-
9
sion.
10
SEC. 3. REFERENCES TO REPORT.
11
(a) Any reference to a ‘‘report accompanying this
12
Act’’ contained in division A of this Act shall be treated
13
as a reference to House Report 116–444. The effect of
14
such Report shall be limited to division A and shall apply
15
for purposes of determining the allocation of funds pro-
16
vided by, and the implementation of, division A.
17
(b) Any reference to a ‘‘report accompanying this
18
Act’’ contained in division B of this Act shall be treated
19
as a reference to House Report 116–446. The effect of
20
such Report shall be limited to division B and shall apply
21
for purposes of determining the allocation of funds pro-
22
vided by, and the implementation of, division B.
23
(c) Any reference to a ‘‘report accompanying this
24
Act’’ contained in division C of this Act shall be treated
25

SEC. 4. AVAILABILITY OF FUNDS.
10
(a) Each amount designated in this Act by the Con-
11
gress as an emergency requirement pursuant to section
12
251(b)(2)(A)(i) of the Balanced Budget and Emergency
13
Deficit Control Act of 1985 shall be available (or re-
14
scinded, if applicable) only if the President subsequently
15
so designates all such amounts and transmits such des-
16
ignations to the Congress.
17
(b) Each amount designated in this Act by the Con-
18
gress for Overseas Contingency Operations/Global War on
19
Terrorism pursuant to section 251(b)(2)(A)(ii) of the Bal-
20
anced Budget and Emergency Deficit Control Act of 1985
21
shall be available (or rescinded, if applicable) only if the
22
President subsequently so designates all such amounts
23
and transmits such designations to the Congress.

$2,626,122,000 is designated by the Congress for Over-

seas Contingency Operations/Global War on Terrorism

pursuant to section 251(b)(2)(A)(ii) of the Balanced
3
Budget and Emergency Deficit Control Act of 1985: Pro-
4
vided further, That funds made available under this head-
5
ing shall be allocated in accordance with paragraphs (1)
6
through (4) as follows:

(1) HUMAN
RESOURCES.—For necessary ex-
8
penses for training, human resources management,
9
and salaries, including employment without regard
10
to civil service and classification laws of persons on
11
a temporary basis (not to exceed $700,000), as au-
12
thorized by section 801 of the United States Infor-
13
mation and Educational Exchange Act of 1948 (62
14
Stat. 11; Chapter 36), $2,999,725,000 (reduced by
15
$1,500,000) (reduced by $5,000,000), of which up
16
to $543,687,000 is for Worldwide Security Protec-
17
tion.

(2) OVERSEAS PROGRAMS.—For necessary ex-
19
penses for the regional bureaus of the Department
20
of State and overseas activities as authorized by law,
21
$1,840,143,000 (reduced by $500,000) (reduced by
22
$5,000,000).

(3) DIPLOMATIC POLICY AND SUPPORT.—For
24
necessary expenses for the functional bureaus of the

Department of State, including representation to

certain international organizations in which the
2
United States participates pursuant to treaties rati-
3
fied pursuant to the advice and consent of the Sen-
4
ate or specific Acts of Congress, general administra-
5
tion, and arms control, nonproliferation, and disar-
6
mament activities as authorized, $774,882,000 (in-
7
creased by $500,000): Provided, That none of the
8
funds made available pursuant to this paragraph
9
shall be available for the official travel of the Sec-
10
retary of State from the period of time between the
11
submission to Congress of the President’s fiscal year
12
2022 budget and the Secretary of State providing
13
written confirmation of a mutually agreed upon date
14
for the Secretary’s participation in a budget hearing
15
before the Committees on Appropriations.
16
(4) SECURITY PROGRAMS.—For necessary ex-
17
penses for security activities, $3,573,445,000, of
18
which up to $3,552,212,000 is for Worldwide Secu-
19
rity Protection.
20
(5) FEES AND PAYMENTS COLLECTED.—In ad-
21
dition to amounts otherwise made available under
22
this heading—
23
(A) as authorized by section 810 of the
24
United States Information and Educational Ex-

change Act, not to exceed $5,000,000, to re-

main available until expended, may be credited
2
to this appropriation from fees or other pay-
3
ments received from English teaching, library,
4
motion pictures, and publication programs and
5
from fees from educational advising and coun-
6
seling and exchange visitor programs; and
7
(B) not to exceed $15,000, which shall be
8
derived from reimbursements, surcharges, and
9
fees for use of Blair House facilities.

(6) TRANSFER
OF
FUNDS, REPROGRAMMING,
11
AND OTHER MATTERS.—
12
(A) Notwithstanding any other provision of
13
this Act, funds may be reprogrammed within
14
and between paragraphs (1) through (4) under
15
this heading subject to section 7015 of this Act.
16
(B) Of the amount made available under
17
this heading, not to exceed $10,000,000 may be
18
transferred to, and merged with, funds made
19
available by this Act under the heading ‘‘Emer-
20
gencies in the Diplomatic and Consular Serv-
21
ice’’, to be available only for emergency evacu-
22
ations and rewards, as authorized.
23
(C) Funds appropriated under this heading
24
are available for acquisition by exchange or pur-

CAPITAL INVESTMENT FUND

For necessary expenses of the Capital Investment
8
Fund,

(reduced
by

$25,000,000), to remain available until expended.

OFFICE OF INSPECTOR GENERAL
11
For necessary expenses of the Office of Inspector
12
General, $90,829,000, of which $13,624,000 may remain
13
available until September 30, 2022: Provided, That funds
14
appropriated under this heading are made available not-
15
withstanding section 209(a)(1) of the Foreign Service Act
16
of 1980 (22 U.S.C. 3929(a)(1)), as it relates to post in-
17
spections.

In addition, for the Special Inspector General for Af-
19
ghanistan Reconstruction (SIGAR) for reconstruction
20
oversight, $54,900,000, to remain available until Sep-
21
tember 30, 2022, which is designated by the Congress for
22
Overseas Contingency Operations/Global War on Ter-
23
rorism pursuant to section 251(b)(2)(A)(ii) of the Bal-
24
anced Budget and Emergency Deficit Control Act of 1985:

Provided, That funds appropriated under this heading

that are made available for the printing and reproduction
2
costs of SIGAR shall not exceed amounts for such costs
3
during the prior fiscal year.

EDUCATIONAL AND CULTURAL EXCHANGE PROGRAMS
5
For necessary expenses of educational and cultural
6
exchange programs, as authorized, $741,700,000 (reduced
7
by $1,400,000), to remain available until expended, of
8
which not less than $277,000,000 shall be for the Ful-
9
bright Program and not less than $116,860,000 shall be
10
for Citizen Exchange Program: Provided, That fees or
11
other payments received from, or in connection with,
12
English teaching, educational advising and counseling pro-
13
grams, and exchange visitor programs as authorized may
14
be credited to this account, to remain available until ex-
15
pended: Provided further, That a portion of the Fulbright
16
awards from the Eurasia and Central Asia regions shall
17
be designated as Edmund S. Muskie Fellowships, fol-
18
lowing consultation with the Committees on Appropria-
19
tions: Provided further, That funds appropriated under
20
this heading that are made available for the Benjamin Gil-
21
man International Scholarships Program shall also be
22
made available for the John S. McCain Scholars Program,
23
pursuant to section 7075 of the Department of State, For-
24
eign Operations, and Related Programs Appropriations

Act, 2019 (division F of Public Law 116–6): Provided fur-

ther, That not less than $5,000,000 of the funds appro-
2
priated under this heading shall be made available for the
3
Global TechGirls Program in the manner specified under
4
this heading in the report accompanying this Act: Pro-
5
vided further, That of the funds made available under this
6
heading for the Fulbright Program, not less than
7
$5,000,000 shall be made available for the English Teach-
8
ing in Africa Program in the manner specified under this
9
heading in the report accompanying this Act: Provided
10
further, That funds appropriated under this heading may
11
be made available for the Civil Society Exchange Program
12
following consultation with the Committees on Appropria-
13
tions: Provided further, That any substantive modifica-
14
tions from the prior fiscal year to programs funded by this
15
Act under this heading shall be subject to prior consulta-
16
tion with, and the regular notification procedures of, the
17
Committees on Appropriations.

REPRESENTATION EXPENSES

protective services, as authorized, $30,890,000, to remain

available until September 30, 2022.

EMBASSY SECURITY, CONSTRUCTION, AND MAINTENANCE

For necessary expenses for carrying out the Foreign
4
Service Buildings Act of 1926 (22 U.S.C. 292 et seq.),
5
preserving, maintaining, repairing, and planning for real
6
property that are owned or leased by the Department of
7
State, and renovating, in addition to funds otherwise avail-
8
able, the Harry S Truman Building, $769,800,000, to re-
9
main available until September 30, 2025, of which not to
10
exceed $25,000 may be used for overseas representation
11
expenses as authorized: Provided, That none of the funds
12
appropriated in this paragraph shall be available for acqui-
13
sition of furniture, furnishings, or generators for other de-
14
partments and agencies of the United States Government.

In addition, for the costs of worldwide security up-
16
grades, acquisition, and construction as authorized,
17
$1,205,649,000, to remain available until September 30,
18
2025, of which $424,287,000 is designated by the Con-
19
gress for Overseas Contingency Operations/Global War on
20
Terrorism pursuant to section 251(b)(2)(A)(ii) of the Bal-
21
anced Budget and Emergency Deficit Control Act of 1985.
