A BILL
To modify and extend the update of the Department of
Defense Freedom of Navigation Report.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘South China Sea Free-
4
dom of Navigation Act’’.
5
SEC. 2. MODIFICATION AND EXTENSION OF UPDATE OF DE-
6
PARTMENT OF DEFENSE FREEDOM OF NAVI-
7
GATION REPORT.

(a) IN GENERAL.—Subsection (a) of section 1275 of
9
the National Defense Authorization Act for Fiscal Year

2017 (Public Law 114–328; 130 Stat. 2540) is amend-

ed—
2
(1) by striking ‘‘an annual basis’’ and inserting
3
‘‘a biannual basis’’; and
4
(2) by striking ‘‘the previous year’’ and insert-
5
ing ‘‘the previous 6 months’’.
6
(b) ELEMENTS.—Subsection (b) of such section is
7
amended—
8
(1) in the matter preceding paragraph (1), by
9
striking ‘‘the year’’ and inserting ‘‘the period’’;
10
(2) in paragraph (1), by inserting ‘‘the number
11
of maritime and overflight challenges to each such
12
claim and’’ before ‘‘the country’’;
13
(3) in paragraph (5), by inserting ‘‘have been
14
protested by the United States but’’ before ‘‘have
15
not been challenged’’; and
16
(4) by adding at the end the following:
17
‘‘(6) A summary of each excessive maritime
18
claim challenged jointly with international partners
19
and allies.’’.

(c) FORM.—Subsection (c) of such section is amend-
21
ed by adding at the end before the period the following:
22
‘‘and made publicly available’’.

(d) SUNSET.—Subsection (d) of such section is

amended by striking ‘‘December 31, 2021’’ and inserting
2
‘‘December 31, 2025’’.

(e) CONFORMING AMENDMENT.—The heading of
4
such section is amended by striking ‘‘ANNUAL’’ and in-
5
serting ‘‘BIANNUAL’’.
