Mr. KINZINGER (for himself, Ms. SPANBERGER, and Mr. MCCAUL) introduced
the following bill; which was referred to the Committee on Foreign Af-
fairs, and in addition to the Committees on Financial Services, Oversight
and Reform, the Judiciary, and Ways and Means, for a period to be sub-
sequently determined by the Speaker, in each case for consideration of
such provisions as fall within the jurisdiction of the committee concerned

To impose sanctions with respect to Turkey’s acquisition
of the S-400 air and missile defense system.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. DETERMINATION AND IMPOSITION OF SANC-
3
TIONS WITH RESPECT TO TURKEY’S ACQUISI-
4
TION OF THE S-400 AIR AND MISSILE DE-
5
FENSE SYSTEM.

(a) FINDINGS AND SENSE OF CONGRESS.—

(1) FINDINGS.—Congress makes the following
1
findings:
2
(A) The Government of Turkey acquired
3
the S-400 air and missile defense system from
4
the Russian Federation beginning on July 12,
5
2019.
6
(B) Such acquisition was facilitated by
7
Turkey’s Presidency of Defense Industries
8
(SSB).
9
(2) SENSE OF CONGRESS.—It is the sense of
10
Congress that it is in the national security interest
11
of the United States—
12
(A) to deter aggression against North At-
13
lantic Treaty Organization (NATO) allies by
14
the Russian Federation or any other adversary;
15
(B) to continue to work with NATO allies
16
to ensure they meet their alliance defense com-
17
mitments, including through adequate and effi-
18
cient investments in national defense;
19
(C) to work to maintain and strengthen
20
the democratic institutions and practices of all
21
NATO allies, in accordance with the goals of
22
Article 2 of the North Atlantic Treaty;
23
(D) to ensure that Turkey remains a crit-
24
ical NATO ally and important military partner

for the United States, contributing to key
1
NATO and United States missions and pro-
2
viding support for United States military oper-
3
ations and logistics needs;
4
(E) to assist NATO allies in acquiring and
5
deploying modern, NATO-interoperable military
6
equipment and reducing their dependence on
7
Russian or former Soviet-era defense articles;
8
(F) to promote opportunities to strengthen
9
the capacity of NATO member states to
10
counter Russian malign influence; and
11
(G) to enforce fully the Countering Amer-
12
ica’s Adversaries Through Sanctions Act (Pub-
13
lic Law 115–44; 22 U.S.C. 9401 et seq.), in-
14
cluding by imposing sanctions with respect to
15
any person that the President determines know-
16
ingly engaged in a significant transaction with
17
a person that is part of, or operates for or on
18
behalf of, the defense or intelligence sectors of
19
the Government of the Russian Federation, as
20
described in section 231 of that Act.
21
(b) DETERMINATION.—The acquisition by the Gov-
22
ernment of Turkey of the S-400 air and missile defense
23
system from the Russian Federation beginning on July
24
12, 2019, shall constitute a significant transaction as de-

scribed in section 231 of the Countering America’s Adver-
1
saries Through Sanctions Act (22 U.S.C. 9525).
2
(c) SANCTIONS.—Not later than 30 days after the
3
date of the enactment of this Act, the President shall im-
4
pose five or more of the sanctions described in section 235
5
of the Countering America’s Adversaries Through Sanc-
6
tions Act (22 U.S.C. 9529) with respect to the Govern-
7
ment of Turkey’s acquisition of the S-400 air and missile
8
defense system from the Russian Federation.

(d) EXCEPTION RELATING
TO IMPORTATION
OF
10
GOODS.—
11
(1) IN GENERAL.—Notwithstanding any other
12
provision of this section, the authorities and require-
13
ments to impose sanctions under this section shall
14
not include the authority or a requirement to impose
15
sanctions on the importation of goods.
16
(2) GOOD
DEFINED.—In this subsection, the
17
term ‘‘good’’ means any article, natural or man-
18
made substance, material, supply or manufactured
19
product, including inspection and test equipment,
20
and excluding technical data.
21
(e) TERMINATION.—The President may terminate
22
the imposition of sanctions required under this section
23
with respect to a person if the President submits to the

appropriate congressional committees a certification
1
that—
2
(1) the Government of Turkey and any person
3
acting on its behalf no longer possesses the S-400
4
air and missile defense system and no such system
5
or successor system is operated or maintained by
6
Russian nationals, or persons acting on behalf of the
7
Government of the Russian Federation, in Turkey;
8
and
9
(2) the President has received reliable assur-
10
ances from the Government of Turkey that the Gov-
11
ernment of Turkey will not knowingly engage, or
12
allow any foreign person to engage on its behalf, in
13
any activity subject to sanctions under section 231
14
of the Countering America’s Adversaries Through
15
Sanctions Act in the future.
