VerDate Sep 11 2014 19:05 Jul 14, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6652 E:\BILLS\H7612.RH H7612 pamtmann on DSKBC07HB2PROD with BILLS 2 •HR 7612 RH Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 That the following sums are appropriated, out of any 3 money in the Treasury not otherwise appropriated, for the 4 Department of the Interior, environment, and related 5 agencies for the fiscal year ending September 30, 2021, 6 and for other purposes, namely: 7 TITLE I 8 DEPARTMENT OF THE INTERIOR 9 BUREAU OF LAND MANAGEMENT 10 MANAGEMENT OF LANDS AND RESOURCES 11 (INCLUDING RESCISSION OF FUNDS) 12 For necessary expenses for protection, use, improve- 13 ment, development, disposal, cadastral surveying, classi- 14 fication, acquisition of easements and other interests in 15 lands, and performance of other functions, including main- 16 tenance of facilities, as authorized by law, in the manage- 17 ment of lands and their resources under the jurisdiction 18 of the Bureau of Land Management, including the general 19 administration of the Bureau, and assessment of mineral 20 potential of public lands pursuant to section 1010(a) of 21 Public Law 96–487 (16 U.S.C. 3150(a)), $1,206,425,000, 22 to remain available until September 30, 2022; of which 23 $100,550,000 for annual and deferred maintenance and 24 $102,620,000 for the wild horse and burro program, as 25 VerDate Sep 11 2014 19:05 Jul 14, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H7612.RH H7612 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 7612 RH authorized by Public Law 92–195 (16 U.S.C. 1331 et 1 seq.), shall remain available until expended: Provided, 2 That amounts in the fee account of the BLM Permit Proc- 3 essing Improvement Fund may be used for bureau-related 4 expenses directly associated with the processing of oil and 5 gas applications for permits to drill and related use of au- 6 thorizations. 7 In addition, $39,696,000 is for Mining Law Adminis- 8 tration program operations, including the cost of admin- 9 istering the mining claim fee program, to remain available 10 until expended, to be reduced by amounts collected by the 11 Bureau and credited to this appropriation from mining 12 claim maintenance fees and location fees that are hereby 13 authorized for fiscal year 2021, so as to result in a final 14 appropriation estimated at not more than $1,206,425,000, 15 and $2,000,000, to remain available until expended, from 16 communication site rental fees established by the Bureau 17 for the cost of administering communication site activities. 18 Of the unobligated balances from amounts made 19 available under this heading in fiscal year 2018 or before, 20 $17,000,000 is permanently rescinded: Provided, That no 21 amounts may be rescinded from amounts originally allo- 22 cated for deferred maintenance and capital improvement 23 activities: Provided further, That no amounts may be re- 24 scinded from amounts that were designated by the Con- 25 VerDate Sep 11 2014 19:05 Jul 14, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H7612.RH H7612 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 7612 RH gress as an emergency requirement pursuant to the Con- 1 current Resolution on the Budget or the Balanced Budget 2 and Emergency Deficit Control Act of 1985. 3 LAND ACQUISITION 4 (INCLUDING RESCISSION OF FUNDS) 5 Of the unobligated balances from amounts made 6 available for Land Acquisition and derived from the Land 7 and Water Conservation Fund, $2,000,000 is hereby per- 8 manently rescinded from projects with cost savings or 9 failed or partially failed projects: Provided, That no 10 amounts may be rescinded from amounts that were des- 11 ignated by the Congress as an emergency requirement 12 pursuant to the Concurrent Resolution on the Budget or 13 the Balanced Budget and Emergency Deficit Control Act 14 of 1985. 15 OREGON AND CALIFORNIA GRANT LANDS 16 For expenses necessary for management, protection, 17 and development of resources and for construction, oper- 18 ation, and maintenance of access roads, reforestation, and 19 other improvements on the revested Oregon and California 20 Railroad grant lands, on other Federal lands in the Or- 21 egon and California land-grant counties of Oregon, and 22 on adjacent rights-of-way; and acquisition of lands or in- 23 terests therein, including existing connecting roads on or 24 adjacent to such grant lands; $115,607,000, to remain 25 VerDate Sep 11 2014 19:05 Jul 14, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H7612.RH H7612 pamtmann on DSKBC07HB2PROD with BILLS 5 •HR 7612 RH available until expended: Provided, That 25 percent of the 1 aggregate of all receipts during the current fiscal year 2 from the revested Oregon and California Railroad grant 3 lands is hereby made a charge against the Oregon and 4 California land-grant fund and shall be transferred to the 5 General Fund in the Treasury in accordance with the sec- 6 ond paragraph of subsection (b) of title II of the Act of 7 August 28, 1937 (43 U.S.C. 2605). 8 RANGE IMPROVEMENTS 9 For rehabilitation, protection, and acquisition of 10 lands and interests therein, and improvement of Federal 11 rangelands pursuant to section 401 of the Federal Land 12 Policy and Management Act of 1976 (43 U.S.C. 1751), 13 notwithstanding any other Act, sums equal to 50 percent 14 of all moneys received during the prior fiscal year under 15 sections 3 and 15 of the Taylor Grazing Act (43 U.S.C. 16 315b, 315m) and the amount designated for range im- 17 provements from grazing fees and mineral leasing receipts 18 from Bankhead-Jones lands transferred to the Depart- 19 ment of the Interior pursuant to law, but not less than 20 $10,000,000, to remain available until expended: Pro- 21 vided, That not to exceed $600,000 shall be available for 22 administrative expenses. 23 VerDate Sep 11 2014 19:05 Jul 14, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H7612.RH H7612 pamtmann on DSKBC07HB2PROD with BILLS 6 •HR 7612 RH SERVICE CHARGES, DEPOSITS, AND FORFEITURES 1 (INCLUDING RESCISSION OF FUNDS) 2 For administrative expenses and other costs related 3 to processing application documents and other authoriza- 4 tions for use and disposal of public lands and resources, 5 for costs of providing copies of official public land docu- 6 ments, for monitoring construction, operation, and termi- 7 nation of facilities in conjunction with use authorizations, 8 and for rehabilitation of damaged property, such amounts 9 as may be collected under Public Law 94–579 (43 U.S.C. 10 1701 et seq.), and under section 28 of the Mineral Leasing 11 Act (30 U.S.C. 185), to remain available until expended: 12 Provided, That notwithstanding any provision to the con- 13 trary of section 305(a) of Public Law 94–579 (43 U.S.C. 14 1735(a)), any moneys that have been or will be received 15 pursuant to that section, whether as a result of forfeiture, 16 compromise, or settlement, if not appropriate for refund 17 pursuant to section 305(c) of that Act (43 U.S.C. 18 1735(c)), shall be available and may be expended under 19 the authority of this Act by the Secretary to improve, pro- 20 tect, or rehabilitate any public lands administered through 21 the Bureau of Land Management which have been dam- 22 aged by the action of a resource developer, purchaser, per- 23 mittee, or any unauthorized person, without regard to 24 whether all moneys collected from each such action are 25 VerDate Sep 11 2014 19:05 Jul 14, 2020 Jkt 099200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H7612.RH H7612 pamtmann on DSKBC07HB2PROD with BILLS 7 •HR 7612 RH used on the exact lands damaged which led to the action: 1 Provided further, That any such moneys that are in excess 2 of amounts needed to repair damage to the exact land for 3 which funds were collected may be used to repair other 4 damaged public lands. 5 Of the unobligated balances from amounts collected 6 in fiscal year 2015 or any prior fiscal year, $20,000,000 7 is permanently rescinded. 8 MISCELLANEOUS TRUST FUNDS 9 In addition to amounts authorized to be expended 10 under existing laws, there is hereby appropriated such 11 amounts as may be contributed under section 307 of Pub- 12 lic Law 94–579 (43 U.S.C. 1737), and such amounts as 13 may be advanced for administrative costs, surveys, ap- 14 praisals, and costs of making conveyances of omitted lands 15 under section 211(b) of that Act (43 U.S.C. 1721(b)), to 16 remain available until expended. 17 ADMINISTRATIVE PROVISIONS 18 The Bureau of Land Management may carry out the 19 operations funded under this Act by direct expenditure, 20 contracts, grants, cooperative agreements and reimburs- 21 able agreements with public and private entities, including 22 with States. up to $100,000 for payments, at 2 the discretion of the Secretary, for information or evidence 3 concerning violations of laws administered by the Bureau; 4 miscellaneous and emergency expenses of enforcement ac- 5 tivities authorized or approved by the Secretary and to be 6 accounted for solely on the Secretary’s certificate, not to 7 exceed $10,000: Provided, That notwithstanding Public 8 Law 90–620 (44 U.S.C. 501), the Bureau may, under co- 9 operative cost-sharing and partnership arrangements au- 10 thorized by law, procure printing services from cooperators 11 in connection with jointly produced publications for which 12 the cooperators share the cost of printing either in cash 13 or in services, and the Bureau determines the cooperator 14 is capable of meeting accepted quality standards: Provided 15 further, That projects to be funded pursuant to a written 16 commitment by a State government to provide an identi- 17 fied amount of money in support of the project may be 18 carried out by the Bureau on a reimbursable basis. 19 UNITED STATES FISH AND WILDLIFE SERVICE 20 RESOURCE MANAGEMENT 21 (INCLUDING TRANSFER AND RESCISSION OF FUNDS) 22 For necessary expenses of the United States Fish and 23 Wildlife Service, as authorized by law, and for scientific 24 and economic studies, general administration, and for the 25 VerDate Sep 11 2014 19:05 Jul 14, 2020 Jkt 099200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H7612.RH H7612 pamtmann on DSKBC07HB2PROD with BILLS 9 •HR 7612 RH performance of other authorized functions related to such 1 resources, $1,387,278,000, to remain available until Sep- 2 tember 30, 2022: Provided, That not to exceed 3 $21,037,000 shall be used for implementing subsections 4 (a), (b), (c), and (e) of section 4 of the Endangered Spe- 5 cies Act of 1973 (16 U.S.C. 1533) (except for processing 6 petitions, developing and issuing proposed and final regu- 7 lations, and taking any other steps to implement actions 8 described in subsection (c)(2)(A), (c)(2)(B)(i), or 9 (c)(2)(B)(ii)): Provided further, That the United States 10 Fish and Wildlife Service may accept transfers of funds 11 from U.S. Customs and Border Protection for mitigation 12 activities, including land acquisition, related to the con- 13 struction of border barriers on Federal lands. 14 Of the funding provided under this heading for cen- 15 tral office operations in the Further Consolidated Appro- 16 priations Act, 2020, $1,000,000 is permanently rescinded: 17 Provided, That no amounts may be rescinded from 18 amounts that were designated by the Congress as an 19 emergency requirement pursuant to the Concurrent Reso- 20 lution on the Budget or the Balanced Budget and Emer- 21 gency Deficit Control Act of 1985. 22 CONSTRUCTION 23 For construction, improvement, acquisition, or re- 24 moval of buildings and other facilities required in the con- 25 VerDate Sep 11 2014 19:05 Jul 14, 2020 Jkt 099200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H7612.RH H7612 pamtmann on DSKBC07HB2PROD with BILLS 10 •HR 7612 RH servation, management, investigation, protection, and uti- 1 lization of fish and wildlife resources, and the acquisition 2 of lands and interests therein; $18,338,000, to remain 3 available until expended. 4 COOPERATIVE ENDANGERED SPECIES CONSERVATION 5 FUND 6 (INCLUDING RESCISSION OF FUNDS) 7 For expenses necessary to carry out section 6 of the 8 Endangered Species Act of 1973 (16 U.S.C. 1535), 9 $23,702,000, to remain available until expended, of which 10 $23,702,000 is to be derived from the Cooperative Endan- 11 gered Species Conservation Fund. 12 Of the unobligated balances made available from the 13 Cooperative Endangered Species Conservation Fund, 14 $11,000,000 is permanently rescinded from projects or 15 from other grant programs with an unobligated carry over 16 balance: Provided, That no amounts may be rescinded 17 from amounts that were designated by the Congress as 18 an emergency requirement pursuant to the Concurrent 19 Resolution on the Budget or the Balanced Budget and 20 Emergency Deficit Control Act of 1985. 21 NATIONAL WILDLIFE REFUGE FUND 22 For expenses necessary to implement the Act of Octo- 23 ber 17, 1978 (16 U.S.C. 715s), $13,228,000. 24 VerDate Sep 11 2014 19:05 Jul 14, 2020 Jkt 099200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\H7612.RH H7612 pamtmann on DSKBC07HB2PROD with BILLS 11 •HR 7612 RH NORTH AMERICAN WETLANDS CONSERVATION FUND 1 For expenses necessary to carry out the provisions 2 of the North American Wetlands Conservation Act (16 3 U.S.C. 4401 et seq.), $46,500,000, to remain available 4 until expended. 5 NEOTROPICAL MIGRATORY BIRD CONSERVATION 6 For expenses necessary to carry out the Neotropical 7 Migratory Bird Conservation Act (16 U.S.C. 6101 et 8 seq.), $4,910,000, to remain available until expended. 9 MULTINATIONAL SPECIES CONSERVATION FU [Text truncated for display.
