PURPOSE. 4 The purpose of this title is to employ a wide range 5 of measures to bring promising clean energy technologies 6 to the point of commercial-availability, including through 7 the activities of a Clean Energy Deployment Administra- 8 tion. 9 Subtitle A—Clean Energy 10 Deployment Administration 11 SEC. 101. DEFINITIONS. 12 In this subtitle: 13 (1) ADMINISTRATION.—The term ‘‘Administra- 14 tion’’ means the Clean Energy Deployment Adminis- 15 tration established by section 103. 16 (2) ADMINISTRATOR.—The term ‘‘Adminis- 17 trator’’ means the Administrator of the Administra- 18 tion. 19 (3) ADVISORY COUNCIL.—The term ‘‘Advisory 20 Council’’ means the Energy Technology Advisory 21 Council of the Administration. 22 (4) BREAKTHROUGH TECHNOLOGY.—The term 23 ‘‘breakthrough technology’’ means a clean energy 24 technology that— 25 VerDate Sep 11 2014 05:13 Aug 06, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H7516.IH H7516 pbinns on DSKJLVW7X2PROD with BILLS 5 •HR 7516 IH (A) presents a significant opportunity to 1 advance the goals developed by the Secretary 2 under section 102, as assessed under the meth- 3 odology established by the Advisory Council; 4 and 5 (B) has not been determined by the Sec- 6 retary to be commercially ready. 7 (5) CLEAN ENERGY TECHNOLOGY.—The term 8 ‘‘clean energy technology’’ means a technology re- 9 lated to the production, use, transmission, storage, 10 control, or conservation of energy that will con- 11 tribute to the stabilization of the climate by reducing 12 greenhouse gas emissions or sequestering or utilizing 13 carbon dioxide and— 14 (A) reduce the need for additional energy 15 supplies by using existing energy supplies with 16 greater efficiency; 17 (B) transmit, distribute, or transport en- 18 ergy with greater effectiveness through the in- 19 frastructure of the United States; or 20 (C) increase and diversify the sources of 21 energy in the United States in a way that will 22 reduce risk to human health, safety, and wel- 23 fare and the environment and create energy se- 24 curity. 25 VerDate Sep 11 2014 05:13 Aug 06, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H7516.IH H7516 pbinns on DSKJLVW7X2PROD with BILLS 6 •HR 7516 IH (6) COST.—The term ‘‘cost’’ has the meaning 1 given the term in section 502 of the Federal Credit 2 Reform Act of 1990 (2 U.S.C. 661a). 3 (7) DIRECT LOAN.—The term ‘‘direct loan’’ has 4 the meaning given the term in section 502 of the 5 Federal Credit Reform Act of 1990 (2 U.S.C. 661a). 6 (8) ENERGY TRANSITION COMMUNITY.—The 7 term ‘‘energy transition community’’ has the mean- 8 ing given such term in section 511 of this Act. 9 (9) FINANCIAL INSTITUTION.—The term ‘‘fi- 10 nancial institution’’ means— 11 (A) an insured bank (as defined in section 12 3(h) of the Federal Deposit Insurance Act (12 13 U.S.C. 1813(h))); 14 (B) a commercial bank or trust company; 15 (C) a private banker; 16 (D) an agency or branch of a foreign bank 17 in the United States; 18 (E) any credit union; 19 (F) a thrift institution; 20 (G) a broker or dealer registered with the 21 Securities and Exchange Commission under the 22 Securities Exchange Act of 1934 (15 U.S.C. 23 78a et seq.); 24 VerDate Sep 11 2014 05:13 Aug 06, 2020 Jkt 099200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H7516.IH H7516 pbinns on DSKJLVW7X2PROD with BILLS 7 •HR 7516 IH (H) a broker or dealer in securities or 1 commodities; 2 (I) an investment banker or investment 3 company; 4 (J) an insurance company; and 5 (K) a loan or finance company. 6 (10) FUND.—The term ‘‘Fund’’ means the 7 Clean Energy Investment Fund established by sec- 8 tion 105(a). 9 (11) LOAN GUARANTEE.—The term ‘‘loan guar- 10 antee’’ has the meaning given the term in section 11 502 of the Federal Credit Reform Act of 1990 (2 12 U.S.C. 661a). 13 (12) NATIONAL LABORATORY.—The term ‘‘Na- 14 tional Laboratory’’ has the meaning given the term 15 in section 2 of the Energy Policy Act of 2005 (42 16 U.S.C. 15801). 17 (13) SECRETARY.—The term ‘‘Secretary’’ 18 means the Secretary of Energy. 19 (14) SECURITY.—The term ‘‘security’’ has the 20 meaning given the term in section 2 of the Securities 21 Act of 1933 (15 U.S.C. 77b). 22 (15) SMALL BUSINESS.—The term ‘‘small busi- 23 ness’’ means a business which is independently 24 owned and operated and which is not dominant in 25 VerDate Sep 11 2014 05:13 Aug 06, 2020 Jkt 099200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H7516.IH H7516 pbinns on DSKJLVW7X2PROD with BILLS 8 •HR 7516 IH its field of operation. The term ‘‘small business’’ 1 may be further defined by the Administrator by the 2 number of employees, dollar volume of business, net 3 worth, net income, or other factors. 4 (16) STATE.—The term ‘‘State’’ means— 5 (A) a State; 6 (B) the District of Columbia; 7 (C) the Commonwealth of Puerto Rico; 8 and 9 (D) any other territory or possession of the 10 United States. 11 SEC. 102. ENERGY TECHNOLOGY DEPLOYMENT GOALS. 12 (a) GOALS.—Not later than 1 year after the date of 13 enactment of this Act, the Secretary, in consultation with 14 the Advisory Council, shall develop and publish for review 15 and comment in the Federal Register near-, medium-, and 16 long-term goals (including numerical performance targets 17 at appropriate intervals to measure progress toward those 18 goals) for the deployment of clean energy technologies 19 through the credit support programs established by this 20 subtitle to promote— 21 (1) the deployment, by not later than 2050, of 22 electric generating capacity with net-zero greenhouse 23 gas emissions, that is sufficient to reliably meet the 24 VerDate Sep 11 2014 05:13 Aug 06, 2020 Jkt 099200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H7516.IH H7516 pbinns on DSKJLVW7X2PROD with BILLS 9 •HR 7516 IH projected energy demand of the United States in 1 2050; 2 (2) clean energy technologies in vehicles and 3 fuels that will substantially reduce the reliance of 4 the United States on foreign sources of energy and 5 insulate consumers from the volatility of global en- 6 ergy markets; 7 (3) a domestic commercialization and manufac- 8 turing capacity that will establish the United States 9 as a world leader in clean energy technologies across 10 multiple sectors; 11 (4) the installation of electricity transmission 12 infrastructure with the capacity to provide the cost- 13 effective deployment of zero-emission electricity tech- 14 nologies appropriate to each region of the United 15 States; 16 (5) the transformation of the building stock of 17 the United States to net zero energy consumption; 18 (6) the recovery, use, and prevention of waste 19 energy; 20 (7) domestic manufacturing of clean energy 21 technologies on a scale that is sufficient to achieve 22 price parity with conventional energy sources; 23 (8) domestic production of commodities and 24 materials, including steel, chemicals, polymers, and 25 VerDate Sep 11 2014 05:13 Aug 06, 2020 Jkt 099200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H7516.IH H7516 pbinns on DSKJLVW7X2PROD with BILLS 10 •HR 7516 IH cement, through the use of clean energy technologies 1 that will establish the United States as a world lead- 2 er in the environmentally-sustainable production of 3 such commodities and materials; 4 (9) a robust, efficient, and interactive electricity 5 transmission grid that will allow for the incorpora- 6 tion of clean energy technologies, distributed genera- 7 tion, smart grid functions, and demand-response in 8 each regional electric grid; 9 (10) a variety of financial products intended to 10 allow owners and users of residential, retail, com- 11 mercial, and industrial buildings to make energy ef- 12 ficiency and distributed generation technology in- 13 vestments with reasonable payback periods; and 14 (11) such other goals as the Secretary, in con- 15 sultation with the Advisory Council, determines to be 16 consistent with this subtitle. 17 (b) REVISIONS.—The Secretary shall revise the goals 18 established under subsection (a), from time to time as ap- 19 propriate, to account for advances in technology and infra- 20 structure. 21 SEC. 103. There shall be at the head of the Administra- 2 tion an Administrator and a Board of Directors, 3 who shall be appointed by the President with the ad- 4 vice and consent of the Senate. 5 (2) STATUS.— 6 (A) IN GENERAL.—The Administration 7 (including officers, employees, and agents of the 8 Administration) shall not be responsible to, or 9 subject to the authority, direction, or control of, 10 any other officer, employee, or agent of the De- 11 partment of Energy other than the Secretary, 12 acting through the Administrator. 13 (B) EXEMPTION FROM REORGANIZA- 14 TION.—The Administration shall be exempt 15 from the reorganization authority provided 16 under section 643 of the Department of Energy 17 Organization Act (42 U.S.C. 7253). 18 (C) INSPECTOR GENERAL.—Section 12 of 19 the Inspector General Act of 1978 (5 U.S.C. 20 App.) is amended— 21 (i) in paragraph (1), by inserting ‘‘the 22 Administrator of the Clean Energy Deploy- 23 ment Administration;’’ after ‘‘Export-Im- 24 port Bank;’’; and 25 VerDate Sep 11 2014 05:13 Aug 06, 2020 Jkt 099200 PO 00000 Frm 00011 F [Text truncated for display.
