To amend titles XI, XVIII, and XIX of the Social Security Act to lower
prescription drug prices in the Medicare and Medicaid programs, to
improve transparency related to pharmaceutical prices and transactions,
to lower patients’ out-of-pocket costs, and to ensure accountability to
taxpayers, and for other purposes.

and Ms. MURKOWSKI) introduced the following bill; which was read twice
and referred to the Committee on Finance
A BILL
To amend titles XI, XVIII, and XIX of the Social Security
Act to lower prescription drug prices in the Medicare
and Medicaid programs, to improve transparency related
to pharmaceutical prices and transactions, to lower pa-
tients’ out-of-pocket costs, and to ensure accountability
to taxpayers, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE; TABLE OF CONTENTS.

(a) SHORT TITLE.—This Act may be cited as the

‘‘Prescription Drug Pricing Reduction Act of 2020’’.

SEC. 101. IMPROVING MANUFACTURERS’ REPORTING OF

AVERAGE SALES PRICES TO SET ACCURATE

PAYMENT RATES.

(a) IN GENERAL.—Section 1847A(f) of the Social Se-
6
curity Act (42 U.S.C. 1395w–3a(f)) is amended—
7
(1) by striking ‘‘PRICE.—For requirements’’
8
and inserting ‘‘PRICE.—
9
‘‘(1) IN GENERAL.—For requirements’’; and
10
(2) by adding at the end the following new
11
paragraph:
12
‘‘(2) MANUFACTURERS THAT DO NOT HAVE A
13
REBATE AGREEMENT.—
14
‘‘(A) IN GENERAL.—For calendar quarters
15
beginning with the second calendar quarter
16
after the date of the enactment of this para-
17
graph, the following provisions shall apply with
18
respect to a manufacturer of an applicable drug
19
or biological (as defined in subparagraph (B))
20
that has not entered into and does not have in
21
effect a rebate agreement described in sub-
22
section (b) of section 1927 in the same manner
23
and to the same extent as such provisions apply

with respect to a manufacturer that has entered

into and has in effect such a rebate agreement:

‘‘(i) Section 1927(b)(3)(A)(iii).

‘‘(ii) Subparagraphs (B) and (C)

(other than the rebate agreement suspen-

sion described in such subparagraph (C))

of section 1927(b)(3).

‘‘(B) APPLICABLE
DRUG
OR
BIOLOGICAL

DEFINED.—For purposes of subparagraph (A),
9
the term ‘applicable drug or biological’ means a
10
drug or biological described in subparagraph
11
(C), (E), or (G) of section 1842(o)(1) or in sec-
12
tion 1881(b)(14)(B) that is payable under this
13
part. For purposes of applying this paragraph,
14
a drug or biological described in the previous
15
sentence includes an item, service, supply, or
16
product that is payable under this part as a
17
drug or biological.’’.

(b) CONFORMING AMENDMENTS.—
19
(1) TITLE XVIII.—Section 1847A(b) of the So-
20
cial Security Act (42 U.S.C. 1395w–3a(b)) is
21
amended—
22
(A) in paragraph (2)(A), by inserting ‘‘or
23
subsection (f)(2), as applicable’’ after ‘‘under
24
section 1927(b)(3)(A)(iii)’’; and

‘‘(J) VALUE.—The term ‘value’ means,

with respect to a coupon (as defined in sub-

paragraph (K)), the difference, if any, be-

tween—

‘‘(i) the amount of any reduction or

elimination of cost-sharing or other out-of-

pocket costs described in such subpara-
9
graph to a patient as a result of the use
10
of such coupon; and

‘‘(ii) any charge to the patient for the

use of such coupon.

‘‘(K) COUPON.—The term ‘coupon’ means

any financial support that is provided to a pa-
15
tient, either directly to the patient or indirectly
16
to the patient through a physician, prescriber,
17
pharmacy, or other provider, under a drug cou-
18
pon program of a manufacturer (as defined in
19
subparagraph (L)) that is used to reduce or
20
eliminate cost-sharing or other out-of-pocket
21
costs of the patient, including costs related to
22
a deductible, coinsurance, or copayment, with
23
respect to a drug or biological, including a bio-
24
similar biological product, of the manufacturer.

‘‘(L) DRUG COUPON PROGRAM.—
1
‘‘(i) IN GENERAL.—Subject to clause
2
(ii), the term ‘drug coupon program’
3
means, with respect to a manufacturer, a
4
program through which the manufacturer
5
provides coupons to patients as described
6
in subparagraph (K).
7
‘‘(ii) EXCLUSIONS.—Such term does
8
not include—
9
‘‘(I) a patient assistance program
10
operated by a manufacturer that pro-
11
vides free or discounted drugs or
12
biologicals, including biosimilar bio-
13
logical products, (through in-kind do-
14
nations) to patients of low income; or
15
‘‘(II) a contribution by a manu-
16
facturer to a nonprofit or Foundation
17
that provides free or discounted drugs
18
or biologicals, including biosimilar bio-
19
logical products, (through in-kind do-
20
nations) to patients of low income.’’.
