To amend the Immigration and Nationality Act to provide
for inadmissibility for certain aliens seeking citizenship
for children by giving birth in the United States, and
for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Ban Birth Tourism
4
Act of 2020’’.

SEC. 2. INADMISSIBILITY FOR ALIENS SEEKING CITIZEN-

SHIP FOR CHILDREN BY GIVING BIRTH IN
2
THE UNITED STATES.

Section 212(a)(10) of the Immigration and Nation-
4
ality Act (8 U.S.C. 1182(a)(10)) is amended by adding
5
at the end the following:
6
‘‘(F) ALIENS SEEKING CITIZENSHIP FOR
7
CHILDREN BY GIVING BIRTH IN THE UNITED
8
STATES.—
9
‘‘(i) IN GENERAL.—Any alien seeking
10
admission as a nonimmigrant under sec-
11
tion 101(a)(15)(B) for the primary pur-
12
pose of obtaining United States citizenship
13
for a child by giving birth to the child in
14
the United States is inadmissible.

‘‘(ii)
RULE
OF
CONSTRUCTION.—
16
Nothing in this subparagraph may be con-
17
strued to render inadmissible an alien
18
seeking legitimate medical treatment relat-
19
ing to childbirth if obtaining citizenship for
20
the child is not the primary purpose for
21
seeking admission.’’.
